| Resumen : | La investigación permitió cumplir con el objetivo general, porque se pudo determinar la incidencia de la aplicación del Código de la Niñez y Adolescencia, en el maltrato de los alumnos del quinto, sexto y séptimos años de Educación Básica, de las Escuelas de la ciudad de Amaluza: Uruguay, Gabriel García Moreno y Nuestra Señora de Nazareth del cantón Espíndola de la provincia de Loja, con el propósito de mejorar la calidad de la educación La finalidad de este Código dispone sobre todo la protección integral que el Estado, la sociedad y la familia deben garantizar a todos los niños, niñas y adolescentes que viven en el Ecuador, con el fin de lograr su desarrollo integral y el disfrute pleno de sus derechos, en un marco de libertad, dignidad y equidad. Para este efecto, regula el goce y ejercicio de los derechos, deberes y responsabilidades de los niños, niñas y adolescentes y los medios para hacerlos efectivos, garantizarlos y protegerlos, conforme al principio del interés superior de la niñez y adolescencia y a la doctrina de protección integral. Las normas del presente Código son aplicables a todo ser humano, desde su concepción hasta que cumpla dieciocho años de edad. Por excepción, protege a personas que han cumplido dicha edad, en los casos expresamente contemplados en este Código. En lo no previsto expresamente por este Código se aplicarán las demás normas del ordenamiento jurídico interno, que no contradigan los principios que se reconocen en este Código y sean más favorables para la vigencia de los derechos de la niñez y adolescencia, es lo que se aborda en esta investigación. En el proceso investigativo, se define al niño, niña y adolescente a la persona que no ha cumplido doce años de edad. Adolescente es la persona de ambos sexos entre doce y dieciocho años de edad. Este Código dispone sobre la protección integral que el Estado, la sociedad y la familia deben garantizar a todos los niños, niñas y adolescentes que viven en el Ecuador, con el fin de lograr su desarrollo integral y el disfrute pleno de sus derechos, en un marco de libertad, dignidad y equidad. Para este efecto, regula el goce y ejercicio de los derechos, deberes y responsabilidades de los niños, niñas y adolescentes y los medios para hacerlos efectivos, garantizarlos y protegerlos, conforme al principio del interés superior de la niñez y adolescencia y a la doctrina de protección integral. La técnica que se utilizó fue la encuesta aplicada a los profesores y padres de familia, la entrevista a los niños, instrumentos que nos permitió precisar las razones de la no aplicación del Código y la incidencia que tiene en el maltrato de los niños, resultados que nos permitieron llegar a conclusiones y sobre todo a recomendaciones para mejorar la calidad de la educación, mejorando las relaciones docentes - padres de familia y alumnos. La población investigada fue de 13 docentes, 78 padres de familia y alumnos del quinto, sexto y séptimo años de Educación Básica de las escuelas: Uruguay, Gabriel García Moreno y Nuestra Señora de Nazareth de la ciudad de Amaluza del cantón Espíndola Como resultados relevantes del trabajo de campo, tenemos que, el desconocimiento que tienen los docentes, alumnos y padres de familia sobre el Código de la Niñez, está incidiendo en el maltrato de los alumnos de las escuelas de la ciudad de Amaluza, se debe a la falta de conocimiento y aplicación del Código de la Niñez. |
| Descripción : | The investigation allowed to fulfill the general objective, because you could determine the incidence of the application of the Code of the Childhood and Adolescence, and its incidence in the abuse in the recruit's students, sixth and seventh years of Basic Education, of those of the city of Amaluza: Uruguay, Gabriel Garcia Moreno and Our Mrs. of Nazareth of the canton Espíndola of the county of Loja, with the purpose of improving the quality of the education The purpose of this Code prepares on the integral protection that the State, the society and the family should guarantee to all the children, girls and adolescents that live in the Ecuador, with the purpose of achieving its integral development and the full enjoyment of their rights, in a mark of freedom, dignity and justness. For this effect, it regulates the enjoyment and exercise of the rights, duties and the children's responsibilities, girls and adolescents and the means to make them troops, to guarantee them and to protect them, conform at the beginning of the superior interest of the childhood and adolescence and to the doctrine of integral protection. The norms of the present Code are applicable to all human being, from their conception until it turns eighteen years of age. For exception, it protects people that have completed this age, in the cases specifically contemplated in this Code. In the no foreseen expressly by this Code the other norms of the internal juridical classification they will be applied that they don't contradict the principles that are recognized in this Code and be more favorable for the validity of the rights of the childhood and adolescence, it is what is approached in this investigation. In the investigative process, he/she is defined to the boy, girl and adolescent to the person that has not turned twelve years of age. Adolescent is the person of both sexes between twelve and eightee years of age. This Code prepares on the integral protection that the State, the society and the family should guarantee to all the children, girls and adolescents that live in the Ecuador, with the purpose of achieving its integral development and the full enjoyment of their rights, in a mark of freedom, dignity and justness. For this effect, it regulates the enjoyment and exercise of the rights, duties and the children's responsibilities, girls and adolescents and the means to make them troops, to guarantee them and to protect them, conform at the beginning of the superior interest of the childhood and adolescence and to the doctrine of integral protection. The technique that was used was the survey applied the professors and family parents, the interview to the children, instruments that he/she allowed to be necessary the reasons of the non-application of the Code and the incidence that he/she has in the abuse of the children, results that they allowed us to reach conclusions and mainly to recommendations to improve the quality of the education, improving the educational relationships - family parents and students. The investigated population was of 13 educational, 78 family parents and the recruit's students, sixth and seventh years of Basic Education of the schools: Uruguay, Gabriel Garcia Moreno and Our Mrs. of Nazareth of the city of Amaluza of the canton Espíndola As outstanding results of the field work, we have that, the ignorance that you/they have the educational ones, students and family parents on the Code of the Childhood, is impacting in the abuse of the students of the schools of the city of Amaluza, he/she is due to the lack of knowledge and application of the Code of the Childhood. |
