| Resumen : | La presente tesis de grado, titulada “Regulación de títulos Habilitantes para la Conducción de Vehículos Eléctricos de Transporte Alternativo de Movilidad Personal”, el interés que nos lleva a desarrollar esta investigación es debido a que en todo el país se ha incrementado considerablemente la circulación de esta clase de vehículos por las vías donde transitan los vehículos tradicionales, poniendo en riesgo la integridad física de todos los actores de la movilidad. El estudio realizado, muestra que la utilización de esta clase de vehículos a incrementado a partir de la pandemia por el SarsCovid-19; la falta de regulación, el bajo precio de estos vehículos, el no exigir ningún tipo de conocimiento sobre Ley de Tránsito, Reglamento, las sanciones establecidas en el Código Orgánico Integral Penal y las normas de convivencia vial entre conductores, la imprudencia de sus conductores los cuales no miden el riesgo que generan al circular por las vías incumpliendo su deber objetivo de cuidado y toda la señalización ubicada en la vía; todas estas acciones coadyuban a que esta circulación genere un riesgo de generar o sufrir un siniestro de tránsito. En la presente tesis se aplicaron materiales y métodos los cuales permitieron el desarrollo de la investigación; se realizaron entrevistas y encuestas a profesionales del derecho, específicamente en la rama del tránsito y seguridad vial, resultados que sirvieron para plantear los proyectos de reforma legal a la Ley Orgánica de Transporte Terrestre, Tránsito y Seguridad Vial; al Reglamento de Aplicación a la Ley Orgánica de Transporte Terrestre, Tránsito y Seguridad Vial y al Código Orgánico Integral Penal, las cuales tienen la finalidad de incorporar la forma de acceder a los títulos habilitantes para la conducción y circulación de esta clase de vehículos, cuáles son sus deberes, derechos y obligaciones; y generar sanciones las cuales cohíban el incumplimiento de la norma por parte de sus conductores. |
| Descripción : | This thesis, entitled "Regulation of Enabling Titles for the Driving of Electric Vehicles for Alternative Transportation of Personal Mobility", the interest that leads us to develop this research is due to the fact that throughout the country the circulation of vehicles has increased considerably. this class of vehicles on the roads where traditional vehicles travel, putting the physical integrity of all mobility actors at risk. The study carried out shows that the use of this class of vehicles has increased since the SarsCovid-19 pandemic; the lack of regulation, the low price of these vehicles, not requiring any type of knowledge about Traffic Law, Regulation, the sanctions established in the Comprehensive Criminal Organic Code and the rules of road coexistence between drivers, the recklessness of their drivers which do not measure the risk they generate when circulating on the roads in breach of their objective duty of care and all the signage located on the road; All these actions contribute to this circulation generating a risk of generating or suffering a traffic accident. In this thesis, materials and methods were applied which allowed the development of the investigation; Interviews and surveys were conducted with legal professionals, specifically in the field of traffic and road safety, results that served to propose legal reform projects for the Organic Law of Land Transport, Traffic and Road Safety; to the Application Regulations to the Organic Law of Land Transport, Traffic and Road Safety and to the Comprehensive Criminal Organic Code, which have the purpose of incorporating the way of accessing the qualifying titles for the driving and circulation of this class of vehicles, which they are your duties, rights and obligations; and generate sanctions which prevent the non-compliance of the norm by its drivers. |
