Resumen : Hasta la fecha, seguramente habremos leído o escuchado que la teoría del caso es la brújula del litigante, es un mapa sobre el que se ha diseñado el transcurso del proceso, es el planteamiento que el fiscal y el abogado defensor hace sobre los hechos penalmente relevantes, los fundamentos jurídicos que lo apoyan y las pruebas que los sustentan. En suma, podemos decir que es una visión estratégica para afrontar el proceso que nos permite: - Tomar las decisiones pertinentes dentro del proceso. - Advertir nuestras debilidades y las de la otra parte. Para construir un discurso excelente y eficaz, que cumpla el fin de convencer a los jueces, es necesario agotar un conjunto sistemático de pasos, que ya desde la antigüedad en las obras de ARISTÓTELES y CICERÓN, comenzaron a ser explicados. Estos pasos que tienen hoy pleno vigor nos servirán de guía para ser aplicados en las diferentes intervenciones orales de un sistema penal acusatorio. En primer lugar, debemos recordar que el fin de las alegaciones orales es persuadir al juez, por eso para lograr ese propósito hay que ser claros. Y para lograr esa claridad es necesario examinar los pasos que se siguen al crear la intervención oral, pues éstos luego nos llevarán a la identificación de la estructura de los alegatos. Los pasos o las etapas que hay que agotar son las siguientes: • La invención (inventio): QUÉ DECIR. Tiene que ver con la acción y el efecto de crear el discurso. • La disposición (dispositio): DÓNDE DECIR. Tiene que ver con la organización, con la construcción de la estructura del discurso. • La expresión (elocutio): CÓMO DECIR. Tiene que ver con la búsqueda del lenguaje apropiado. • La memoria (memoria): Tiene que ver con la capacidad para recordar lo que se va a decir. • La práctica (praxis): Tiene que ver con el hecho de realizar ejercicios acerca del discurso que se ha creado para llegar a pronunciarlo mejor. • El diseño de apoyos audiovisuales. Tiene que ver con el uso de medios que permitan transmitir, comprender y recordar la información. • La pronunciación (pronuntiatio). Tiene que ver con la acción concreta de hablar. La invención tiene que ver con la acción y el efecto de crear el discurso. En este primer paso, el escritor o el orador busca qué es lo que va a decir. Es la parte creativa en la producción de los alegatos, en la cual para persuadir, primero hay que definir el objetivo u objetivos que se buscan con el discurso; luego, buscar la información, las fuentes que sirvan de inspiración para alcanzar el fin propuesto. El discurso judicial tiene un objetivo general y uno o varios objetivos específicos, que al ser concretados permiten construir lógicamente el discurso. El objetivo general es persuadir, convencer. Persuadir significa ganar la adhesión a la tesis o teoría del caso que se plantea, es lo que se desea que el auditorio o público crea o decida. De ahí la importancia que en esta fase se procure conocer al auditorio, en particular al juez y a los jurados que desea convencer, esto le permitirá adaptarse a su público y precisar sus objetivos. Es fundamental analizar el auditorio, por cuanto esto guía para determinar los objetivos, desarrollar estrategias, seleccionar el material de apoyo, organizar el material y pronunciar el discurso. El objetivo u objetivos específicos versan sobre lo que de manera concreta se desea que el auditorio comprenda, haga o decida. En los discursos persuasivos cada una de las partes plantea una hipótesis de solución al problema debatido que permite perfilar el discurso. El proceso es una contienda entre hipótesis en competencia que el juez tiene la tarea de dirimir. Por ejemplo, la Fiscalía pretenderá que se declare responsable al acusado, por homicidio intencional; mientras que el defensor, que el juez se convenza de que el acusado actuó en defensa justa. Cada pretensión define los contenidos del discurso, por esto, para que este sea eficaz es clave que en el proceso de creación se tenga claro cuál es la Teoría del Caso o la hipótesis central que vamos a defender, cuáles son los problemas jurídicos que el asunto plantea, pues esto nos permitirá buscar las pruebas y las razones que soporten nuestra Teoría, organizar el discurso y luego pronunciarlo con fundamentos sólidos.
Descripción : To date, surely we will have read or heard that the theory of the case is the compass of the litigant , is a map that is designed during the process , is the approach that the prosecutor and the defense attorney makes about relevant criminal acts , the legal grounds that support it and the evidence supporting them . In short, we can say that it is a strategic vision to address the process that allows us to: - Take appropriate decisions in the process . - Warn our weaknesses and those of the other party. To build an excellent and effective speech that meets to convince the judges , it is necessary to exhaust a systematic set of steps, which since ancient times in the works of Aristotle and Cicero , began to be explained. These steps have full force today will guide us to be applied to the various interventions of oral accusatory system . First, we must remember that the purpose of oral argument is to persuade the judge, so to achieve that purpose must be clear . And to achieve that clarity is necessary to examine the steps used to create the oral intervention , as these then lead us to the identification of the structure of the allegations. The steps or stages to be exhausted are: • The invention ( inventio ) : WHAT TO SAY . It has to do with the action and the effect of creating the speech. • The provision ( dispositio ) : WHERE TO SAY . It has to do with the organization, with the construction of the discourse structure . • The expression ( elocutio ) : HOW TO TELL . It has to do with finding the appropriate language. • Memory (Memory) : It has to do with the ability to remember what was going to say. • The practice (praxis ) : It has to do with the fact exercises on the speech that was created to get to pronounce it better. • The design of audiovisual material. It involves the use of means to convey , understand and recall information . • Pronunciation ( pronuntiatio ) . It has to do with the specific action of speaking. The invention is related to the action and the effect of creating the speech. In this first step , the writer or speaker seeks what he'll say . It is the creative part in the production of the allegations , in which to persuade , you must first define the objective or objectives sought with the speech , then look for the information sources will inspire to achieve the intended purpose . The judicial discourse is general purpose and one or more specific objectives, which allow to construct logically be concretized discourse. The overall objective is to persuade, convince. Persuade means to win accession to the thesis or theory of the case in question, it is what you want the audience or make public or decided. Hence the importance in this phase seeks to know the audience, including the judge and convince the jury that you want , this will allow you to adapt to your audience and clarify your goals . It is essential to analyze the audience, because this guide to determine objectives, develop strategies, selecting material support, organize the material and deliver the speech. The target or targets are about concretely what you want the audience to understand, do or decide. Persuasive speeches on each of the parties raises a hypothesis discussed problem solution allows shape the discourse. The process is a contest between competing hypotheses that the judge has the task of settling. For example, the prosecution will seek a declaration that the defendant liable for murder, while the defense, the judge is convinced that the defendant acted in a fair defense. Each claim defines the contents of the speech, so , for this to be effective it is essential that the process of creation is clear about what the Case Theory and the central hypothesis that will defend , what the legal issues are the matter poses , as this will allow us to find the evidence and the reasons that support our theory , discourse organization and then pronounce it with strong fundamentals .
