Título : ELIMINACIÓN DE LA CADUCIDAD DEL REGIMEN TRIBUTARIO ECUATORIANO

Resumen : El Ecuador es un País en el cual actualmente se recaudan ingresos a través del pago de tributos quizás hoy con más concurrencia que en administraciones anteriores, este pago es beneficioso para el País ya que con la recaudación se puede solventar las múltiples labores que está realizando el Estado. La Administración Tributaria es el agente recaudador de tributos ordena que los ciudadanos o sujetos pasivos realicemos declaraciones de los ingresos y egresos que atravesamos cotidianamente ya sea como funcionarios, trabajadores o comerciantes. La declaración se la realiza de acuerdo a los plazos establecidos en el Reglamento de la Ley Orgánica de Régimen Tributario Interno, una vez realizada la declaración según el artículo 94 del Código Tributario existen tres plazos para que la Administración Tributaria quede imposibilitada de ejercer la facultad determinadora la cual consiste en verificar la declaración del sujeto pasivo. Los plazos son cumplidos, pero se debe considerar que a través de la recaudación de impuestos se solventa el gasto público e inversión pública, por tal razón no puede dejarse de cobrar y verificar la legalidad hoy lo que por ley le corresponde al sujeto pasivo cancelar. Por ello no debería existir límite de tiempo para ejercer la recaudación y verificación de tributos por los organismos pertinentes, ya que son múltiples los ciudadanos que participan como sujeto pasivo, en tal virtud la Administración Tributaria realiza el 3 mismo procedimiento recaudador a todos los ciudadanos que actúan como sujeto pasivo. En otras palabras lo que se pretende es impulsar y defender el interés colectivo del interés individual, ya que la caducidad se produce por negligencia del administrador. Existen pensamientos escritos por autores expertos en materia tributaria quienes de manera colectiva concuerdan manifestando que la caducidad de la facultad de determinar y verificar tributos por parte de la administración es inconstitucional, debido a que está en contra del bien colectivo, este tipo de actos no sirve para otra cosa que no sea el ocultar la inobservancia de los funcionarios encargados de realizar la determinación y verificación de tributos, así mismo la Constitución y Código Tributario regulan los principios en los cuales se fundamentan para realizar la recaudación de tributos en los que cuenta principalmente el principio de legalidad. La metodología aplicada nos ha permitido demostrar a través de la investigación y análisis de cómo afecta la caducidad en el régimen tributario, afectación que se hace presente a través de disminución de ingresos para el ente público, lo cual implica que el gasto público e inversión pública disminuya en la nación afectando no solo a ciertas personas sino a toda la ciudadanía en general. A través de la encuesta y entrevista se logró obtener el criterio de la ciudadanía y se concluyó que mediante la determinación y verificación de tributos se logra comprobar que los contribuyentes realicen el pago respectivo que por ley les corresponde cancelar, con la finalidad de impedir 4 la evasión del pago de tributos, así mismo se obtuvo que es necesario eliminar la caducidad del régimen tributario ecuatoriano para permitir al administrador que realice la determinación y verificación en el tiempo y espacio que el crea conveniente. Dentro del objetivo general y específicos durante el desarrollo del presente trabajo se los cumplió a cabalidad realizando el estudio doctrinario, jurídico y demostrando como afecta la caducidad al régimen tributario y por qué la necesidad de eliminarla del mismo. Luego de haber cumplido y analizado cada temática planteada se llegó a varias conclusiones que han sido sustentadas con el presente trabajo investigativo, conclusiones tales como la improcedencia de la caducidad en el régimen tributario, la legalidad de proceder con la determinación y verificación de tributos por parte de administrador, entre otras. En cuanto a las recomendaciones es necesario concientizar a la ciudadanía que a través de la recaudación de tributos se logra solventar el gasto público e inversión pública y que es necesario y preferible para evitar ser amonestados que los contribuyentes realicen sus declaraciones de manera voluntaria mas no exigible; y la necesidad de realizar una reforma al Código Tributario con la finalidad de eliminar la caducidad del régimen tributario.
Descripción : Ecuador is a country which currently revenue through taxes levied perhaps more competition today than in previous administrations, this payment is beneficial for the country as through fund can solve the multiple tasks that are made by the State. As the tax authorities ordered collection agent of taxes that citizens or taxpayers perform statements of income and expenses that we go through every day either as officials, workers or traders. This statement is done according to the terms established in the Regulations of the Organic Law of Internal Tax Regime, once the declaration under article 94 of the Tax Code there are three deadlines for the Tax Administration is unable to exercise the power determiner which is to verify the statement of the taxpayer. These deadlines must be met, but one must consider that through tax revenues can fund public spending and public investment, for that reason can not be allowed to charge what legally belongs to the taxpayer cancel. There should be no time limit for tax collection exercise through the relevant agencies, as are many citizens who participate as a taxable person in such under the Tax Administration must make the same collector process to all citizens who act as passive subject. In other words what the aim is to promote and defend the collective interests of individual interest. 6 There are thoughts written by expert authors in tax matters who collectively agree stating that the revocation of the power to determine and verify taxes by the administration is unconstitutional because it is against the public good, such acts do not serve for anything other than hiding the failure of officials to conduct the identification and verification of taxes, also the Constitution and Tax Code governing the principles on which they are based for tax collection in which mainly account principle of legality. The methodology has allowed us to demonstrate through research and analysis of how it affects the expiration in the tax regime, which is present affected by lower revenue for the public body, which means that public spending and public investment decrease in the nation affecting not only certain people but to all citizens in general. Through the survey and interview it was possible to obtain the criterion of citizenship and concluded that through the identification and verification of taxes is done to check that taxpayers make the respective payment prescribed by law you cancel, in order to prevent evasion payment of taxes, and it was obtained that is necessary to remove the expiration of Ecuador's tax regime to allow the administrator to perform the identification and verification in time and space creates convenient. Within the general and specific during the development of this study objective was fully achieved by performing the doctrinal, legal and study demonstrating how it affects the expiration of the tax regime and why the need to eliminate it. Having met and discussed each issue raised several conclusions that have been supported with this research work, conclusions such as the inadmissibility of the expiration in the tax system, the legal proceeding with the determination and verification of taxes reached by administrator, among others. As for the recommendations necessary to sensitize the public through the collection of taxes is achieved fund public spending and public investment that is necessary and preferable to avoid being warned that taxpayers made their statements voluntarily but not required ; and the need for an amendment to the Tax Code in order to eliminate the expiration of the tax system.
