Título : Necesidad de reformar el art. 262 del Código de la Niñez y Adolescencia, en relación a quien debe juzgar a los adolescentes infractores

Resumen : El Art. 226 del Código Orgánico de la Función Judicial, manifiesta que en cada distrito habrá el número de juezas y jueces, entre otros, de adolescentes infractores, que establezca el Consejo de la Judicatura, con la determinación de la localidad de su residencia y de la circunscripción territorial en la que tengan competencia, en caso de no establecer esta determinación se entenderá que es distrital. Pero es el caso que el Consejo de la Judicatura ha considerado que en el juzgamiento de los adolescentes infractores, éstos sean juzgados por los jueces de la niñez y adolescencia, esto se debe por las normas contempladas en el Art. 262 del Código de la Niñez y Adolescencia que establece que el juzgamiento de adolescentes se hará por los jueces de la materia, que ellos les corresponde dentro de sus respectivas jurisdicciones territoriales, el conocimiento y resolución de los asuntos relacionados con la responsabilidad del adolescente infractor . Los adolescentes infractores deben ser juzgados y sancionados por un juez especializado en materia penal, pues que sean juzgados por un Juez de la Niñez y Adolescencia de acuerdo al Código del mismo nombre, hacen a nuestro criterio ineficiente el procesamiento de adolescentes infractores, cuando éste juez es especializado en materia de asuntos de alimentos, tenencia, adopción, patria potestad, entre otras que son de tipo civil, pero en materia penal para resolver asuntos de adolescentes infractores deben existir jueces especializados en esta materia, permitiendo tener un juez natural para que lleve a cabo el juzgamiento de las infracciones. Los sujetos procesales en juzgamiento cometido por adolescentes infractores son: el juez, los procuradores de adolescentes infractores y el adolescente inculpado. Siendo el juez de la niñez y adolescencia la persona que ejerce la jurisdicción, que representa al órgano jurisdiccional y encargado de dar inicio al proceso y resolver mediante sentencia los asuntos de su competencia, con lo cual inicia con la apertura de la instrucción, dispone la detención o competencia del imputado, fija la caución y concede la libertad provisional, dispone la realización y actuación de medios de prueba, dicta otras medidas cautelares de carácter personal y real como embargo, incautación, etc. La creación de los jueces especializados penal para el juzgamiento de adolescentes infractores, contribuye a tener una justicia especializada, donde se tome en cuenta como aspecto fundamental el interés superior del adolescente, en la que deben aplicarse como principios, los señalados en el Art. 168 de la Constitución de la República del Ecuador, entre ellos el numeral sexto que la sustanciación de los procesos en todas las materias, instancias, etapas y diligencias se llevará a cabo mediante el sistema oral, de acuerdo con los principios de concentración, contradicción y dispositivo. Es indudable que el Código de la Niñez y Adolescencia ha mejorado ciertas instituciones jurídicas específicas, entre ellas la Responsabilidad Penal del Adolescente Infractor, sin embargo, dado el tiempo de aplicación de las normas del Código de la Niñez y Adolescencia, se ha podido detectar un problema que ha toda luz, se convierte en una violación al debido proceso y se trata de que, el mismo Juez de la Niñez y Adolescencia, también es uno Controlador de Garantías, actúa como Juez Juzgador del ilícito cometido por el adolescente

Juvenile offenders should be tried and punished by a special judge in criminal matters, because they are tried by a Judge for Children and Adolescents under the Code of the same name, make our inefficient approach processing juvenile offenders when it judge is specialized in matters of alimony, custody, adoption, custody, among others that are civil, but in criminal matters to resolve issues of adolescent offenders should be specialized in this area judges, allowing to have a tribunal to carry out the prosecution of offenses. The procedural subjects prosecution committed by juvenile offenders are the judge, the attorneys of adolescent offenders and adolescent accused. As the judge of childhood and adolescence the person exercising jurisdiction, representing the court and charged with initiating the process and solve a judgment matters within its competence, which begins with the opening of instruction, has the detention or competency of the accused, fixed bail and parole granted, provides implementation and performance evidence, introducing other precautionary measures personal and real character, seizure, etc. The creation of specialized courts for criminal prosecution of juvenile offenders, contributes to a specialized justice, which is taken into account as a fundamental aspect of the adolescent interest, which must be applied as principles, referred to in Art. 168 of the Constitution of the Republic of Ecuador, including the sixth paragraph substantiation of processes in all subjects, levels, steps and proceedings will be conducted by the oral system in accordance with the principles of concentration, contradiction and device .
