Resumen : La presente tesis titulada “Extensión de la conciliación hasta antes de la etapa de juicio en delitos de transito que no tengan resultados de muerte, ni de lesiones graves que generen incapacidad permanente, pérdida o inutilidad de algún órgano”, se basa sobre la aplicación de la conciliación en delitos de tránsito en los cuales sea posible conciliar de acuerdo a las disposiciones del Art, 663 numeral 2 del Código Orgánico Integral Penal, para dar fin a un conflicto por medio de un acuerdo favorable y satisfactorio entre las partes, ayudando a descongestionar la labor de los juzgadores, aplicando el principio de economía procesal y el principio de mínima intervención penal o de ultima ratio, los acuerdos a los que lleguen las partes tendrán carácter de solución y deberá ser cumplida de acuerdo a las condiciones a las que se haya llegado entre las partes, caso contrario de no ser cumplida será revocada sin opción a poder ser de nuevo solicitada y se podrá continuar con el proceso planteado en la vía penal, de ser saneado el acuerdo acorde a las disposiciones acordadas tomara fuerza de cosa juzgada y se dará por concluido el proceso penal que fue conocido por el Fiscal. La conciliación es un medio alternativo de solución de conflictos que agilita la resolución de conflictos que se suscitan entre las personas en el diario convivir como es el caso por delitos de tránsito en los cuales se podrá conciliar y así evitar gastos innecesarios no solo al Estado, sino también a 3 las partes implicadas en el conflicto, ya que al convertirse en un proceso penal se deberá hacer gasto en patrocinio de un defensor. Dentro de la cual se planteó un objetivo general y tres específicos que ayudaron a esclarecer el tema central de la investigación y una hipótesis la que puntualiza el vacío legal existente el cual es el centro de la investigación. El acopio teórico, jurídico y doctrinario, la aplicación de encuestas y entrevistas, permitió obtener criterios con fundamentos claros y precisos, de bibliografía muy reconocida, que aportaron a la verificación de los objetivos y a la contrastación de la hipótesis planteada referentes a la conciliación en delitos de tránsito; tanto la Constitución de la República del Ecuador, como la ley penal que tipifican el derecho a la aplicación de medios alternativos a la solución de conflictos de las persona implicadas dentro de un proceso penal por estos delitos.
Descripción : This thesis entitled "Extension of the conciliation up to before the trial stage in traffic crimes that do not have death results, and injuries that generate permanent disability, loss or disability of any body", is based on the application of the conciliation in the offenses of maritime traffic in the art of the sea, 663 numeral 2 of the Integral Penal Organic Code, to give rise to a conflict by means of a favorable and satisfactory agreement between the parties, helping to decongest the work of the evaluators, applying the principle of the procedural economy and the principle of minimum criminal intervention or last resort, the agreements that the parties have the nature of the solution and are complementary to the same conditions as the others reached between the parties, otherwise it will be revoked the option to be able to be newly requested and may continue with the process raised in criminal proceedings, if the agreement is sanitized according to the provisions agreed upon for the force of the res judicata and the criminal proceeding that was known by the Prosecutor was terminated. The conciliation is an alternative means of conflict resolution that expedites the resolution of conflicts that arise among people in the newspaper coexist as is the case for traffic crimes in which it can be reconciled and thus avoid unnecessary expenses not only to the State, but also to the parties involved in the conflict, since by becoming a criminal proceeding the sponsoring of a defender must be spent. 5 Within which raised a general objective and three specific ones that helped to clarify the central topic of the investigation and a hypothesis that points out the existing legal vacuum which is the center of the investigation. The theoretical, legal and doctrinaire collection, the application of surveys and interviews, allowed to obtain criteria with clear and precise bases, of well-known bibliography, which contributed to the verification of the objectives and to the test of the hypothesis raised regarding the conciliation in crimes traffic; both the Constitution of the Republic of Ecuador, and the criminal law that typify the right to the application of alternative means to the solution of conflicts of the persons involved in a criminal proceeding for these crimes
