Resumen : El manejo del patrimonio de los menores de edad es una institución jurídica por la cual el titular o titulares no están en capacidad de administrar sus bienes, sino que está supeditado al manejo de un tercero denominado tutor o curador según el caso el bien inmueble que está bajo esta condición porque el dueño está condicionado para administrarlo por razones de su edad. La representación de los menores ha sido abordada desde tiempos remotos, estando sustentada en las limitaciones de obrar de determinadas personas, se plantea en la doctrina, que aparece como respuesta del ordenamiento jurídico a situaciones de hecho o de derecho que presentan ciertas personas, a las cuales por sus limitaciones no les está dado realizar determinados actos jurídicos válidos de ahí la necesidad de la representación. Se considera a la representación como la autorización concedida en ley por la persona interesada mediante un acto jurídico, en virtud de la cual el representante tiene facultades para sustituir al representado, ocupando su lugar como sujeto de la relación jurídica, es, evidentemente, distinto el obrar en nombre de otro, que obrar bajo el nombre de otro. En un caso hay representación y en el otro falsificación o suplantación. En el mundo moderno se polemiza a la representación como la actuación en nombre de otro, atendiendo a que en la vida práctica acontecen situaciones en las que se justifica el anonimato del nombre que se representa, de ahí que reciba mayor aceptación la definición de que el acto del representante se realiza. En el ordenamiento ecuatoriano se define la representación, limitándose en el Código Civil a establecer que el acto jurídico puede realizarse por medio de un representante conforme a la norma no se limita que la representación opere únicamente en el ámbito de los contratos sino todo lo contrario; admite una extensión amplia del fenómeno representativo, pudiendo ser utilizado en cualquier acto jurídico donde se manifiesta la voluntad de una persona con el propósito de producir efectos jurídicos. En la doctrina moderna consta aceptado que la persona que realiza el acto no lo hace en su propio interés, por lo tanto, los efectos jurídicos que del mismo se derivan repercuten directamente en beneficio o perjuicio de la persona que autoriza la realización del acto; mucho se ha discutido acerca de la naturaleza jurídica de la representación, diferentes teorías tratan de explicar cuál es la importancia que tienen las voluntades del representado y del representante, en el negocio representativo, es decir, en el celebrado entre el representado y el tercero; se trata de explicar cuál es la voluntad manifestada en el negocio jurídico representativo, o la del representante; pero la cuestión no tiene exclusivamente un carácter teórico, sino eminentemente práctico, porque proyecta la fijación de la persona en quién deben concurrir los vicios de la voluntad que anulan la declaración de voluntad o a la que hay que referir las condiciones subjetivas que puedan ser relevantes para la celebración del negocio o para determinar sus efectos
