dc.descriptionThe Constitution of the Republic of the Ecuador in their Art. 326 establish the labor guarantees that aid the rights of the workers, firstly assuring a worthy and fair remuneration, the unrenunciability and intangibility of the rights of the workers, as well as other constitutional dispositions that guarantee the juridical security. The Mandate Constituent Number 8 sent by the Constituent Assembly in the Civic Center "Ciudad Alfaro" April of the year 2008, it suppresses the outsourcing of services and labor intermediation to consider them that attempts to the rights of the workers, and in their place it settles down the denominated complementary activities, consistent in activities of surveillance, security, feeding, messaging and cleaning unaware to the user's habitual activity. At the present time our country the recruiting of workers in the different modalities of contracts of the complementary activities, the rights of the workers are harmed, especially those consecrated in the Art. 326 of the Constitution of the Republic of the Ecuador, with respect to the labor stability, to the juridical security and the right of associating freely. These companies of complementary activities when hiring the personnel that the users require, although it is certain they make a civil contract (mercantile) with the characteristics of the contract type that require, the user fulfills the company, however this last one doesn't fulfill the obligations in front of the workers, bringing a affectation of the rights, guarantees and subscribed other Treated Internments and ratified by the Ecuador. When two contracts in the Complementary Activities, the one exist is civil between the company of complementary activities and the user, for which the first one provides of personnel for activities of cleaning, feeding, messaging, security and surveillance. And the other one is a labor contract that one gives between the company and the workers, but the labor stability is harmed, since the company assigns a work to the worker when there is an user's demand, and if the user no longer decides to continue requiring the complementary services, the worker is left without activity that to carry out for some time depending on the demand of other users, and likewise it doesn't have labor stability. Same way it produces that the company of complementary activities to work should obtain juridical personarum and the corresponding operation authorization on the part of the Regional Direction of the Work, but once in operation it is not affiliating to the workers to the Social Security, without counting that neither they pay the remunerations according to the sectorial charts, because the user cancels those values to the company of complementary activities, so that this last one cancels the workers, and in the alone reality they are paid the unified basic wage, that is to say, there is nonfulfillment on the part of these companies. The companies of complementary activities don't allow the association of the workers in Syndicates or Committees of Company, because the labor activity is the one that the user provides, in an indirect form, because legally the labor relationship is between the company and the workers, but that it happens if there is not users' demand, then there is not work to assign to the worker and likewise they cannot pay if there is not work to carry out. The company of complementary activities is also the one in charge of liquidating the workers, discharging from this obligation to the user, and I eat at the moment it is evidenced the companies they constantly liquidate its workers and likewise these they cannot exercise its right to associate in syndicates, company committees, unions and other forms settled down in the Constitution of the Republic of the Ecuador. The present artificial investigation seeks to create obligations and effective sanctions before any type of affectation of the workers' rights under the modality of complementary activitieses_ES
dc.description.abstractLa Constitución de la República del Ecuador en su Art. 326 establece las garantías laborales que amparan los derechos de los trabajadores, primeramente asegurando una remuneración digna y justa, la irrenunciabilidad e intangibilidad de los derechos de los trabajadores, así como otras disposiciones constitucionales que garantizan la seguridad jurídica. El Mandato Constituyente Nro. 8 expedido por la Asamblea Constituyente en el Centro Cívico “Ciudad Alfaro” Montecristi el 30 de abril del año 2008, suprime la tercerización de servicios e intermediación laboral por considerarlas atentatorias a los derechos de los trabajadores, y en su lugar se establece las denominadas actividades complementarias, consistentes en actividades de vigilancia, seguridad, alimentación, mensajería y limpieza ajenas a la actividad habitual de la usuaria. En la actualidad nuestro país la contratación de trabajadores en las diferentes modalidades de contratos de las actividades complementarias, se vulneran los derechos de los trabajadores, especialmente los consagrados en el Art. 326 de la Constitución de la República del Ecuador, referente a la estabilidad laboral, a la seguridad jurídica y al derecho de asociarse libremente. Estas compañías de actividades complementarias al contratar el personal que requieren las usuarias, si bien es cierto hacen un contrato civil (mercantil) con las características del tipo de contrato que requieren, la usuaria cumple con la empresa, sin embargo esta última no cumple con las obligaciones frente a los trabajadores, trayendo una vulneración de los derechos, garantías y demás Tratados Internaciones suscritos y ratificados por el Ecuador. Al existir dos contratos en las Actividades Complementarias, el uno es civil entre la empresa de actividades complementarias y la usuaria, por el cual la primera provee de personal para actividades de limpieza, alimentación, mensajería, seguridad y vigilancia. Y el otro es un contrato laboral que se da entre la empresa y los trabajadores, pero se vulnera la estabilidad laboral, ya que la empresa le asigna una labor al trabajador cuando hay demanda de una usuaria, y si la usuaria decide ya no seguir requiriendo los servicios complementarios, el trabajador se queda sin actividad que realizar por algún tiempo dependiendo de la demanda de otras usuarias, y por ende no tiene estabilidad laboral. De igual forma se produce que la empresa de actividades complementarias para funcionar debe obtener personería jurídica y la correspondiente autorización de funcionamiento por parte de las Direcciones Regionales del Trabajo, pero una vez en funcionamiento no se está afiliando a los trabajadores al Seguro Social, sin contar que tampoco pagan las remuneraciones de acuerdo a las tablas sectoriales, debido a que la usuaria cancela esos valores a la empresa de actividades complementarias, para que esta última cancele a los trabajadores, y en la realidad solo se les paga el básico unificado, es decir, hay incumplimiento por parte de estas empresas. Las empresas de actividades complementarias no permiten la asociación de los trabajadores en Sindicatos o Comités de Empresa, debido a que la actividad laboral es la que proporciona la usuaria, en una forma indirecta, pues legalmente la relación laboral es entre la empresa y los trabajadores, pero que sucede si no hay demanda de usuarias, entonces no hay labor que asignarle al trabajador y por ende no pueden pagar si no hay trabajo que realizar. Además la empresa de actividades complementarias es la encargada de liquidar a los trabajadores, exonerando de esta obligación a la usuaria, y como actualmente se evidencia las empresas liquidan constantemente a sus trabajadores y por ende estos no pueden ejercer su derecho a asociarse en sindicatos, comités de empresa, gremios y demás formas establecidas en la Constitución de la República del Ecuador. La presente investigación jurídica pretende crear obligaciones y sanciones efectivas ante cualquier tipo de vulneración de derechos de los trabajadores bajo la modalidad de actividades complementariases_ES
