dc.descriptionIn the Ecuador and the world we find ourselves in a much more reasonable ideological and moral evolution that in times of the Roman Empire and the emergence of the Soviet Union, despite a point being positive, there are still legal, family, cultural, or social problems that cause dissatisfaction in society, being far from the utopia of a perfect world. The Union of fact was born as a legal figure to protect the couples formed between a man and a woman, who are free from marriage, live together in a stable and monogamous, having formed thus in fact a home, in order to live together, to procreate and to aid with each other, the same that gives rise to a society of property subject to the regime of the conjugal partnership, which implies to recognize each other rights and obligations (very similar to the marriage), and who does not want to get married and is recognized by competent authority. In the Ecuadorian environment appears as a social need, to give legal validity to irregular joints and avoid legal problems that occur in the future, in a way this instrument contributes to the development of our society and so take their effects is regulated in the Constitution and the Civil Code, legal institution that requires priority attention, due to the high increase of this type of unions in recent decades and the Civil Registry, identification and documentation, does not have a specialized and limited registration to do so, leaving in limbo the unions actually legalized and not them to register so that they take the respective legal effects. It has also influenced the high index of de facto unions, the enactment of the current Constitution where the legalization of unions is left as indeed open between people of the same sex. Ultimately, the union in fact at any time must be protected by the recognition of the State and society both in its formation, effects, regime of goods and even its shape to end their existence, i.e., through its legal terminationes_ES
dc.description.abstractEn el Ecuador y en el Mundo nos encontramos en una evolución ideológica y moral mucho más razonable que en épocas del imperio Romano o de la aparición de la Unión Soviética, a pesar de ser un punto positivo, surgen todavía problemas legales, familiares, culturales o sociales, que causan inconformidad en la sociedad, estando muy lejos de la utopía de un Mundo perfecto. La Unión de Hecho nació como una figura jurídica para proteger a las parejas conformadas entre un hombre y una mujer, que estén libres de vínculo matrimonial, convivan en forma estable y monogámica, habiendo de esta forma formado de hecho un hogar, con el fin de vivir juntos, procrear y auxiliarse mutuamente, la misma que da origen a una sociedad de bienes sujeta al régimen de la sociedad conyugal, lo que implica reconocerse mutuamente los derechos y obligaciones (muy parecidas a las del matrimonio) y que no quieran contraer matrimonio y se encuentre reconocida ante autoridad competente. En el medio ecuatoriano aparece como una necesidad social, para dar validez legal a las uniones irregulares y evitar problemas jurídicos que se producen en un futuro, de alguna manera este instrumento aporta al desarrollo de nuestra sociedad y para que surta sus efectos se encuentra regulado en la Constitución de la República y en el Código Civil, institución jurídica que requiere una atención prioritaria, debido al alto incremento de este tipo de uniones en las últimas décadas y el Registro Civil, Identificación y Cedulación, no cuenta con un registro especializado y taxativo para ello, quedando en el limbo la uniones de hecho legalizados y al no poderlas inscribir para que surtan los efectos legales respectivos. También ha influenciado en el alto índice de uniones de hecho, la promulgación de la actual Constitución donde se deja abierta la legalización de uniones de hecho entre personas del mismo sexo. En definitiva, la unión de hecho en toda época debe estar protegida por el reconocimiento del Estado y la sociedad tanto en su conformación, efectos, régimen de bienes e inclusive en su forma de poner fin a su existencia, es decir, a través de su terminación legales_ES
