Resumen : El matrimonio concebido dentro de nuestro marco legal y el de casi la mayoría de legislaciones del mundo es una institución social que crea un vínculo conyugal entre sus miembros. Este lazo es reconocido socialmente, ya sea por medio de disposiciones jurídicas o por la vía de los usos y costumbres. El matrimonio establece entre los cónyuges, y en muchos casos también entre las familias de origen de éstos, una serie de obligaciones y derechos que también son fijados por el derecho, que varían, dependiendo de cada sociedad. El matrimonio más allá de ser un vínculo conyugal, es la institución social configurante de la familia, y por ende, encontrando relación directa con las tasas de natalidad de las sociedades en donde se consoliden. Se constituye además como base económica del desarrollo de las sociedades, tanto así, que en torno a esta figura se cristalizan las principales acciones comerciales y económicas que permiten su sustento y progreso, no personal sino, de todo el núcleo familiar. Por ser una institución sumamente extendida en el mundo, aunque no de modo universal, la definición del matrimonio es materia de diversas disciplinas. Desde el punto de vista del derecho occidental, el matrimonio constituye una unión de dos personas que tiene por finalidad constituir una familia. Hasta hace pocos años se consideraba un elemento esencial de la definición el hecho que ambos contrayentes debían ser de sexo opuesto, pero en el último tiempo este elemento ha sido objeto de moderaciones debido a la apertura, en algunos ordenamientos, al matrimonio entre personas del mismo sexo. Por su lado, en vista de la información etnográfica obtenida de diversas sociedades, la antropología del parentesco define el matrimonio como la unión de dos o más personas que cumplen roles de género definidos socialmente, incluso tratándose de matrimonios homosexuales. El matrimonio, desde el punto de vista antropológico, es una institución que permite legitimar la descendencia de una mujer y crea relaciones de alianza entre los grupos de parentesco de los cuales provienen sus miembros. En el marco de la presente investigación, hemos concebido al matrimonio como la base económica de una sociedad, por lo tanto y adentrándonos en nuestra legislación, si observamos que para fines tributarios, dentro de una pareja de cónyuges, cada uno puede obtener su propio Registro Único de Contribuyentes, con la finalidad de aportar al fisco con parte de sus ingresos como impuesto a la renta y otros, no es concebible, que en fines netamente comerciales, para su expansión y desarrollo de ser el caso, si la intensión de los esposos de conformar una compañía de responsabilidad limitada, para hacerse beneficiario incluso de mejores condiciones laborales, nuestra legislación, prohíba que participen como socios u accionistas de esta clase de compañías, considerando la diversificación comercial y globalizadora mundial. El matrimonio puede ser civil o religioso y, dependiendo de la religión o del ordenamiento jurídico, los derechos, deberes y requisitos del matrimonio son distintos. Ahora bien, no todas las sociedades establecen la distinción entre matrimonio civil y matrimonio religioso. Esta distinción sólo puede existir en aquellos contextos donde el Estado ha atraído el reconocimiento del matrimonio como una de sus atribuciones. En algunos países occidentales el matrimonio civil no ha sido reconocido hasta fechas relativamente recientes. Por ejemplo, Chile lo reconoce desde 1884. Argentina, lo hace desde 1888, en virtud de la Ley 2393. Algunos estados que han adoptado el matrimonio civil no reconocen las uniones conyugales realizadas bajo las normas religiosas, otros las reconocen como opción con validez jurídica equivalente al matrimonio civil. En contraparte, las religiones no suelen reconocer el matrimonio civil como una forma de unión conyugal acorde con sus preceptos
Descripción : The marriage conceived inside our legal frame and of almost the majority of legislations of the world it is a social institution that believes a conjugal link between his members. This bow is recognized socially, already be by means of juridical dispositions or for the route of the uses and customs. The marriage establishes between the spouses, and in many cases also between the families of origin of these, a series of obligations and rights that also are fixed by the right, which they change, depending on every company. The marriage beyond being a conjugal link, is the social institution of the family, and for, finding direct relation with the rates of birthrate of the companies where they are consolidated. There are constituted in addition as economic base of the development of the companies, so much this way, that concerning this figure crystallize the principal commercial and economic actions that allow his sustenance and progress, not personnel but, of the whole familiar core. For being an institution extremely extended in the world, though not in a universal way, the definition of the marriage is a matter of diverse disciplines. From the point of view of the western right, the marriage constitutes an union of two persons that has for purpose constitute a family. Until a few years ago it was considered the fact an essential element of the definition that both contrayentes had to be of opposite sex, but in the last time this element has been an object of moderations due to the opening, in some classifications, to the marriage between persons of the same sex. For his side, in view of the ethnographic information obtained of diverse companies, the anthropology of the kinship defines the marriage as the union of two or more persons who fulfill definite roles of social, enclosed kind treating itself about homosexual marriages. The marriage, from the anthropologic point of view, is an institution that allows to legitimize the descent of a woman and believe relations of alliance between the kin groups from which his members come. In the frame of the present investigation, we have conceived to the marriage as the economic base of a company, therefore and entering our legislation, if we observe that for tributary ends, inside a pair of spouses, each one can obtain his Contributors' own Only Record, with the purpose of reaching to the exchequer with part of his income as tax to the revenue and others, it is not conceivable, that in net commercial ends, for his expansion and development of being the case, if the intenseness of the spouses Of shaping a company of limited responsibility, he become an enclosed beneficiary of better working conditions, our legislation, prohibit that they take part as partners or shareholders of this class of companies, considering the commercial and global world diversification. The marriage can be civil or religious and, depending on the religion or on the juridical classification, the rights, duties and requirements of the marriage are different. Now then, not all the companies establish the distinction between civil wedding and church wedding. This distinction only can exist in those contexts where the State has attracted the recognition of the marriage as one of his attributions. In any western countries the civil wedding has not been recognized up to relatively recent dates. For example, Chile recognizes it from 1884. Argentina, it does it from 1888, by virtue of the Law 2393. Some conditions that have adopted the civil wedding do not recognize the conjugal unions realized under the religious procedure, others recognize them as option with juridical validity equivalent to the civil wedding. In counterpart, the religions are not in the habit of recognizing the civil wedding as a form of conjugal union according to his rules
