Resumen : La legislación ecuatoriana, tiene procedimientos especiales, que al tratarse de las pensiones alimenticias, son los niños, niñas y adolescentes los que tienen todos los derechos sin excepción alguna; según sus principios de aplicación, como es el derecho a alimentos considerados indivisibles, de igual jerarquía y se los debe gozar de manera progresiva, el derecho a alimentos es uno de los derechos que la Constitución garantiza de forma integral y su vulneración limita la supervivencia y desarrollo integral de los niños, niñas o adolescentes, quienes por su situación de vulnerabilidad merecen atención prioritaria. La Constitución de la República del Ecuador en su artículo 6, dispone: “Art. 6.- Todas las ecuatorianas y los ecuatorianos son ciudadanos y gozarán de los derechos establecidos en la Constitución. La nacionalidad ecuatoriana es el vínculo jurídico político de las personas con el Estado, sin perjuicio de su pertenencia a alguna de las nacionalidades indígenas que coexisten en el Ecuador plurinacional. La nacionalidad ecuatoriana se obtendrá por nacimiento o por naturalización y no se perderá por el matrimonio o su disolución, ni por la adquisición de otra nacionalidad” . Los alimentos y los derechos de los niños deben ser garantizados mediante las leyes, y que se obligan a buscar el bien común, y sobre todo el derecho de los niños, niñas y adolescentes de la sociedad ecuatoriana, por lo que los derechos de los alimentantes y alimentados no deben ser conculcados por consiguiente las reformas legales deben estar dentro del debido proceso y respetando las garantías constitucionales y legales. Dentro del marco jurisprudencial no existe sinomia entre derechos o garantías si los mismos están establecidos en la Constitución y garantizados en su Supremacía o en los instrumentos internacionales como; más cuando se trata de los niños, niñas y adolescentes en el Ecuador; y que, debe prevalecer sus derechos así mismo, debe disponer de un procedimiento sencillo y breve por lo cual la justicia ampare dicho derecho sin limitaciones y condiciones que ponga en tela de duda los derechos de los adolescentes cuando éstos se encuentran estudiando hasta la culminación de sus estudios superiores, acatando los principios de libertad garantizados en la constitución

Within the jurisprudential framework there is no sinomia between rights or guarantees if they are established in the Constitution and guaranteed their supremacy or international instruments such as; more when it comes to children and adolescents in the Ecuador; and that their rights must prevail, you must have a short and simple procedure by which justice protects this right without limitations and conditions that put in doubt fabric the rights of adolescents when they are studying until completion of their studies, abiding by the principles of freedom guaranteed in the Constitution
