dc.descriptionThis thesis is in its most practical sense, an analysis naturally focused on a very stark reality that occurs within the scope of "AMENDMENTS TO THE CONSTITUTION OF THE REPUBLIC OF ECUADOR REGARDING HABEAS CORPUS". In this situation generates helplessness in small and larger cantons of our country, therefore, the solemnity that exists in the judicial units makes habeas corpus, have a duration from 48 hours to a few weeks, so if the detainee no ballot detention within 24 hours, you can benefit from the Habeas Corpus, but to raise the action before a judge, it takes less than forty-eight hours he remained in helplessness because in that time it will already be legalized their arrest and could not qualify for Habeas Corpus Thus my thesis research relates to this issue that certainly generates legal uncertainty, so it became necessary to introduce doctrinal, conceptual and legal sources that allowed me to address the legal institution of habeas corpus as a judicial and new warranty constitutional law to be known by the court that is taking autonomy in the future development of society and law. In the research I was useful criterion investigated population coincided with my view that it is necessary to amend the Constitution of the Republic of Ecuador incorporating my proposed such action as the mayor knows that in small cantons are creating the legal uncertainty and especially breaking the filing of habeas corpus In this context, this thesis is a reference that invites us to reflect on this situation generates defenseless small cantons and larger in our country, therefore, the solemnity that exists in the judicial units makes habeas corpus , have a duration from 48 hours to a few weeks, so if the detainee has no ballot detention within 24 hours, you can benefit from the Habeas Corpus, but to raise the action before a judge, lasts at least forty eight hours, defenseless because it stay within that time and his arrest will be legalized and ineligible to Habeas Corpus. dc.description.abstractEl presente trabajo de tesis constituye en su sentido máspráctico, un análisis enfocado naturalmente en una realidad muy cruda que acontece dentro del Ámbito de “REFORMAS A LA CONSTITUCIÓN DE LA REPÚBLICA DEL ECUADOR RESPECTO AL HÁBEAS CORPUS”. Ante esta situación genera indefensión en los cantones pequeños y más grandes de nuestro país, pues, la solemnidad que existe en las unidades judiciales hace que las acciones de hábeas corpus, tengan una duración desde 48 horas hasta algunas semanas, por ello, si el detenido no tiene boleta de privación de libertad dentro de las 24 horas, puede acogerse al Hábeas Corpus, pero si para plantear la acción ante un Juez, le dura mínimo cuarenta y ocho horas, éste quedara en indefensión porque dentro de ese tiempo ya estará legalizada su detención y no podría acogerse al Hábeas Corpus De este modo mi investigación de tesis se refiere a esta problemática que genera sin duda alguna inseguridad jurídica, por lo que se hizo necesario presentar referentes doctrinarios, conceptuales y jurídicos que me permitieron abordar la institución jurídica del habeas corpus como una garantía jurisdiccional y nueva en el Derecho Constitucional para que sea conocida por el órgano jurisdiccional que va tomando autonomía en el devenir del desarrollo de la sociedad y el derecho. En la investigación me fue útil el criterio de la población investigada que coincidió con mi criterio de que es necesario reformar la Constitución de la República del Ecuador incorporando mi propuesta de que dicha acción la conozca el Alcalde ya que en los cantones pequeños se está creando la inseguridad jurídica y sobre todo violando la interposición del Hábeas Corpus. En este marco, la presente tesis constituye un referente que nos invita a la reflexión sobre esta situación que genera indefensión en los cantones pequeños y más grandes de nuestro país, pues, la solemnidad que existe en las unidades judiciales hace que las acciones de hábeas corpus, tengan una duración desde 48 horas hasta algunas semanas, por ello, si el detenido no tiene boleta de privación de libertad dentro de las 24 horas, puede acogerse al Hábeas Corpus, pero si para plantear la acción ante un Juez, le dura mínimo cuarenta y ocho horas, éste quedara en indefensión porque dentro de ese tiempo ya estará legalizada su detención y no podría acogerse al Hábeas Corpus.
