While art forty nine of the Labour Code establishes the limits within which the employer must pay compensation for the working class but it is also true that that provision is not complied with since there is no drastic sanctions that force you the payment of fair compensation, without thereby the worker to claim their rights by administrative and judicial remedies that eventually ends with the breakdown of labor relations. Fair remuneration and timely results that the worker can develop more interest and responsibility in the exercise of its function; and also helps you to their economic development and therefore the whole family, thereby safeguarding their rights and Constitutional guarantees. We note that at present the Ministry of what labor has begun to undertake visits and audits to different institutions, companies, factories and other reviewing the documentation of workers and making relevant comments to the violation of compliance set out in the Code working towards their wages and overtime. It is therefore one of the aims that persecuted in this project was to establish the different legal framework that all those who work in a public institution, what are its benefits, duties, rights and obligations, legal norms are fastened that are applicable when a sanction, what labor competent authorities are, if they have committed a violation of their rights, authority sets their remuneration, ie, it is intended to grant a manual that allows to know their rights as workers or private servers to which you are entitled. This project seeks to benefit the worker in particular the private sector to practice their constitutional rights and guarantees are not violated; and the detected problem is solved, that is why by this investigation is to carry out a project to reform the labor code which requires the employer to fulfill its obligations in an accurate manner without evasions more than recognize not twenty-five percent if not increased by fifty percent. In the study we will detect inadequate constant legal regulations in the Labour Code regarding the payment of fair wages and time workers in the private sector which violates his rights and the universal principle of work also provides elements of reform the Labour Code to ensure the right of workerses_ES
dc.description.abstractEl presente proyecto tiene por título “Reforma al art. 49 del código de trabajo, a fin de determinar en un cincuenta por ciento adicional las jornadas extraordinarias, para los trabajadores del sector privado”, me he visto en la necesidad de que por medio de este proyecto se logre precautelar el derecho que les asiste a los trabajadores que en el desarrollo cotidiano se encuentran vulnerados por parte de los empleadores que no pagan sus remuneraciones en el tiempo determinado por la Ley el contrato o la costumbre; y lo que es peor en muchos casos abusa la clase empleadora de que no existen fuentes de trabajo en el Ecuador y contratan a sus trabajadores bajo condiciones remuneratorias por debajo de las establecidas y sin el pago de horas suplementarias y extraordinarias. Es evidente la violación a los derechos del trabajador que se produce por parte del empleador, especialmente en el ámbito privado, ya que abusando de su poder económico y de su jerarquía como clase poderosa de cierta forma somete al trabajador a que realice una labor determinada bajo sus condiciones y totalmente contrarias a la ley. Si bien es cierto el Art. 49 del Código de Trabajo establece los plazos dentro de los cuales el empleador debe pagar la remuneración a favor de la clase obrera pero también es cierto que dicha disposición no es acatada ya que no existe sanciones drásticas que le obliguen al pago de remuneración justas, sin que por ello el trabajador tenga que exigir sus derechos por vías administrativas y judiciales que a la larga termina con el resquebrajamiento de las relaciones laborales. Una remuneración justa y a tiempo da como resultado que el trabajador pueda desarrollarse con mayor interés y responsabilidad en el ejercicio de su función; así como también lo ayuda a su desarrollo económico y por ende al de toda su familia, precautelando sus derechos y garantías Constitucionales. Debemos resaltar que en la actualidad el Ministerio de lo laboral ha comenzado a realizar visitas y auditorías a las diferentes instituciones, empresas, fábricas y otras, revisando la correspondiente documentación de los trabajadores y realizando las observaciones pertinentes a la violación del cumplimiento establecido en el Código de trabajo, con respecto a sus remuneraciones, y horas extras. En las legislaciones del mundo se ha perfeccionado al contrato llamado de trabajo, y que se encuentra acogido en la legislación ecuatoriana en el art. 49; jornada nocturna, entendiéndose por tal la que se realiza entre las 19:00 y 6:00 del día siguiente, podrá tener la misma duración y dará derecho a igual remuneración que la diurna, aumentada en un veinticinco por ciento, en forma clara adopta esta definición. La remuneración es un elemento esencial lo que significa que el empleador debe pagar un salario por los servicios prestados por el trabajador, puesto que se convierte en una obligación básica del empleador, para cumplir con ella, debe hacerlo además en el tiempo y en lo que debe ceñirse a la ley, emitida por resolución de la autoridad administrativa competente para hacerlo como es el consejo nacional de salarios (CONADES) o mediante acuerdos del ministerio de lo laboral. En la práctica hay casos que no se cumple por parte de los empleadores sin el reconocimiento de horas suplementarias, extraordinarias, vulnerando totalmente el derecho de sus trabajadores; puesto que el exceso de trabajo y el no pago a tiempo puede ocasionar grandes problemas en la salud y en la economía diaria del trabajador y toda su familia. Es por ello, que entre los fines, que perseguí en este proyecto, fue establecer los diferentes marco legales, que se sujetan todas aquellas personas que laboran dentro de una institución pública, cuáles son sus beneficios, deberes, derechos y obligaciones, las normas legales que le son aplicables al momento de una sanción, cuáles son las autoridades competente laborales, en caso que se hubiere cometido una violación a su derechos, que autoridad fija sus remuneraciones, es decir, se pretende otorgar un manual que permita conocer los derechos como trabajadores o servidores privados a que tiene derecho. El presente proyecto busca beneficiar al trabajador en especial al del sector privado, para que en la práctica sus derechos y garantías constitucionales no sean vulnerados; y, que el problema detectado sea solucionado, es por ello que mediante la presente investigación, se pretende realizar un proyecto de reforma al código de trabajo que exija al empleador el cumplimiento de sus obligaciones de una manera exacta y sin evasiones a más de reconocer no el veinticinco por ciento si no aumentada en un cincuenta por ciento. En el estudio vamos a detectar la inadecuada normativa jurídica constante en el Código del Trabajo en lo referente al pago de remuneraciones justas y a tiempo de los trabajadores del sector privado en la que vulnera sus derechos y el principio universal del trabajo, además establece elementos de reforma al Código del Trabajo para garantizar el derecho de los trabajadoreses_ES
