| Resumen : | La presente tesis de grado tiene por título “Ejecución en horas no hábiles del allanamiento del lugar por apremio personal en materia de alimentos, vulnera el derecho constitucional de integridad e intimidad del obligado y su familia”, surge la necesidad de su realización debido al análisis del Código Orgánico General de Procesos en el artículo 137 al no determinarse un horario específico para la realización de dicho allanamiento lo que vulnera derechos fundamentales tanto del obligado como de la familia con la que convive, incluyendo a los menores que se encuentran presentes al momento de la detención. El apremio personal es una medida que si bien, no es la mejor opción es la más factible para garantizar el cumplimento del pago en el tiempo correspondiente, pero al momento de hablar de allanamiento del lugar es necesario establecer los derechos que se ven violentados y las personas que presencian resultan ser menores de edad o personas de tercera edad que se ven afectados sus derechos constitucionales. En el desarrollo de la tesis se aplicaron materiales y métodos, así mismo se llevaron a cabo la aplicación entrevistas y encuestas a profesionales del derecho, resultados que sirvieron para plantear el proyecto de reforma legal al Código Orgánico General de Procesos para garantizar los derechos del obligado deudor en materia de alimentos, su familia y en especial de los niños y adolescentes que presencian la detención. La realización del allanamiento en horas hábiles asegura en gran parte que el obligado no se encuentre en su domicilio, donde no se vea vulnerado el derecho de integridad e intimidad personal establecidos en la Constitución de la República del Ecuador. |
| Descripción : | The present thesis is entitled "Execution in non-business hours of the search of the place by personal constraint in matters of alimony, violates the constitutional right of integrity and intimacy of the obligor and his family", the need for its realization arises due to the analysis of the General Organic Code of Processes in article 137 when not determining a specific schedule for the realization of such search which violates fundamental rights of both the obligor and the family with whom he lives, including the minors who are present at the time of the arrest. The personal constraint is a measure that, although it is not the best option, it is the most feasible to guarantee the compliance of the payment in the corresponding time, but at the moment of talking about the search of the place it is necessary to establish the rights that are violated and the people who are present are minors or senior citizens whose constitutional rights are affected. In the development of the thesis, materials and methods were applied, as well as the application of interviews and surveys to legal professionals, results that served to propose the project of legal reform to the General Organic Code of Processes to guarantee the rights of the obligor debtor in matters of maintenance, his family and especially of the children and adolescents who witness the detention. The realization of the search during business hours ensures to a large extent that the obligor is not at home, where the right to personal integrity and privacy established in the Constitution of the Republic of Ecuador is not violated. |
