Título : LA INDEPENDENCIA DE LAS FUNCIONES DEL ESTADO FRENTE AL HIPERPRESIDENCIALISMO

Resumen : El hiperpresidencialismo es entendido como la injerencia que el ejecutivo ejerce sobre los otros poderes y sobre la estructura del Estado en general. En el presente trabajo de tesis, es mi cometido investigar si en el Ecuador existe o no hiperpresidencialismo, y si este se manifiesta debido a las elecciones meritocráticas de las autoridades que forman parte de La Función de Transparencia y Control Social, y la Función Electoral, situación que a mi concepción debe regularse con el fin de garantizar una verdadera independencia de poderes. A partir de la creación de la Constitución de la República del Ecuador, en Montecristi en el año 2008, en nuestro país se dieron algunos cambios, unos con alteraciones casi imperceptibles, pero otros sustanciales y de gran peso, tal y como la creación de dos nuevas funciones del Estado, la Función de Transparencia y Control Social, y la Función Electoral. Ilustrada en el derecho comparado, únicamente he podido encontrar la creación de nuevas funciones en sus Constituciones, en los países que pertenecieron al ALBA, (Alianza Bolivariana para los Pueblos de Nuestra América Tratado de Comercio de los Pueblos), Venezuela y Bolivia, organismo creado por el difunto presidente Chávez. “En Sudamérica está la tendencia creciente de instituir reformas constitucionales, a menudo por medio de asambleas constitucionales que concentran el poder en las manos del Ejecutivo, a la vez que castran a la asamblea legislativa y al órgano judicial. El ejemplo más dramático es el de Venezuela con Chávez, pero se observan patrones similares en Bolivia, y Ecuador”. (Vivero, 2010) Un sistema de frenos y contrapesos dado por la separación de poderes evitaría la excesiva concentración del poder en el gobierno central, ya que actualmente nos encontramos ante una grieta que rompe la concepción clásica de la división tripartita de poderes. 3 ¿Qué pasa cuando un “iluminado”, o un “erudito por antonomasia”, logra captar el apoyo popular junto con el 70 % de asambleístas de la Bancada Legislativa, y lleva como principal proyecto electoral la creación de una nueva Constitución, ¿Qué ocurre cuando no existe una oposición importante que permita la armonía en la toma de la creación de leyes? Pasa que en primer lugar dotamos de un “súper poder” a la persona y a su séquito, de hacer y deshacer a su antojo, ya que no hay quien controle los alcances de las leyes creadas por el Legislativo con la venia del Ejecutivo o viceversa, entonces es aquí cuando nos alejamos de lo que es considerado como un Estado democrático, ya que la democracia conlleva la posibilidad de que existan medios de participación por parte de la ciudadanía, de que existan diferencias entre los participantes de dicho proceso y de que se expresen opiniones contrapuestas. ¿Quiénes son aquellos que se encuentran al frente de estos dos nuevos poderes? Aparentemente representantes de los grupos sociales que provengan de un grupo debidamente registrado como organización social, hasta aquí podríamos hablar de cierta inclusión, pero, en este punto, “cabe destacar el ataque que vivieron las organizaciones en nuestro país, ya que la persecución fue sistemática y dirigida contra personas y grupos sociales que se opusieron a Correa o denunciaron la corrupción” (Porras, 2019), y como ya ocurrió en muchos otros casos, “fue justamente las leyes creadas para tal efecto, las que permitieron eliminar a varias de las organizaciones existentes en el país”. (Jácome, 2019), como por ejemplo con el decreto 16, en el cual constan requisitos para poder mantenerse como organización social, quedando como consecuencia únicamente aquellas adeptas al gobierno de turno, eliminando así toda posibilidad de oposición inteligente, que genere un contrapeso entre los poderes y permita un equilibrio racional entre gobierno y el pueblo.Para Paulo Arrobo presidente del Colegio de Abogados de la ciudad de Loja “El expresidente Rafael Correa no concebía la idea de que organizaciones y gremios con una amplia representación puedan llegar a discrepar con su criterio, por eso buscó desaparecerlos creando normas y leyes que afectaban principalmente a la parte económica.” (Arrobo, 2018) Desde la eliminación de organizaciones en el país, ya tenemos un auténtico problema, porque para la elección de los miembros del Consejo de Participación Ciudadana y Control social, entidad principal de la Función de Transparencia y Control Social, fueron tomados en cuenta únicamente aquellas personas que formaban parte de las organizaciones, que tuvieron la “suerte” por así decirlo de evitar su eliminación, ¿Cómo?, ¿cumpliendo requisitos indispensables y necesarios según la ley, o, cediendo ante la presión por parte del representante del Ejecutivo?. Pues bien, nos encontramos en que como candidatos para Consejo de Participación Ciudadana y Control Social únicamente podrían participar miembros de las organizaciones que no está por demás decirlo “sobrevivieron”, entonces aquí es donde empieza a confluir esta quimera, de inclusión ciudadana. Es fácil, analizando a la luz del discernimiento y como ecuatorianos que vivimos la llamada “Década ganada”, comprender hacia donde nos llevó aquella situación, los candidatos para consejeros del Consejo de Participación Ciudadana y Control Social, eran aquellos que gozaban con la aprobación del Ejecutivo, así que cualquiera resultara ganador en los concursos no atentaba contra la voluntad omnipotente del representante del Ejecutivo. De manera superflua explicaré lo que sucede a continuación, los consejeros son los encargados de designar a las autoridades de control, a la primera autoridad de la Defensoría del Pueblo, Defensoría Pública, Fiscalía General del Estado y Contraloría General del Estado, también a los del Consejo Nacional Electoral, Tribunal Contencioso Electoral y 5 Consejo de la Judicatura, y ya de manera más directa designar a la primera autoridad de la Procuraduría General del Estado y de las superintendencias de entre las ternas propuestas por la Presidenta o Presidente de la República, Es por ello que en la presente investigación quiero hacer eco de lo que muchos tratadistas han criticado duramente, la creación de dos nuevos poderes o funciones como son llamadas actualmente, La Función de Transparencia y Control Social, y la Función Electoral, y más aún, la elección de sus miembros mediante concursos meritocráticos y no en votación universal.
Descripción : Hyperpresidentialism is understood as the interference that the executive exerts on other powers and on the structure of the State in general. In the present thesis work, it is my goal, to demonstrate that hyper-presidentialism is allowed by the insertion of the Transparency and Social Control Function, and the Electoral Function in the Constitution of the Republic of Ecuador of the year 2008, a situation that must be regulated with in order to guarantee true independence of powers. Since the creation of the Montecristi Constitution in 2008, some changes were made in our country, some with almost imperceptible alterations, but others with substantial and heavy weight, such as the creation of two new functions of the State, The Transparency and Social Control Function, and the Electoral Function. Illustrated in comparative law, I have only been able to find creation of new functions in its Constitutions, in the countries that belonged to ALBA, (Bolivarian Alliance for the Peoples of Our America Treaty of Peoples' Trade), Venezuela and Bolivia, an organization created by the late President Chavez, in and the current and international reading is sufficient to form an accurate criterion of being countries failed by the Hypersidentialism covered by its Constitutions. (Michael, 2010). A system of checks and balances given by the separation of powers would avoid excessive concentration of power in the central government, since we are currently facing a crack that breaks the classical conception of the tripartite division of powers. What happens when an “enlightened one”, or a “scholar by par excellence”, manages to capture popular support along with 70% of Assembly members of the Legislative Bank, and has as its main electoral project the creation of a new Constitution, what happens when there is no significant opposition that allows harmony in the making of the creation of laws? It happens that in the first place we provide a “super power” to the person and his entourage, to do and undo at will, since there is no one who controls the scope of the laws created by the 7 Legislature with the permission of the Executive or vice versa, then it is here that we move away from what is considered a democratic State, since democracy entails the possibility of citizen participation, that there are differences between the participants in that process and that they express themselves opposing opinions. Who are those who are at the forefront of these two new powers? Apparently representatives of social groups that come from a group duly registered as a social organization, so far we could talk about a certain inclusion, but, on this point, “it is worth noting the attack that organizations in our country experienced, since the persecution was systematic and directed against people and social groups that opposed Correa or denounced corruption ”(Porras, 2019), and as already happened in many other cases,“ it was precisely the laws created for this purpose, which allowed eliminating several of the existing organizations in the country ”. (Jacome, 2019), as for example with decree 16, which includes requirements to be able to maintain itself as a social organization, leaving as a consequence only those adept at the government in office, thus eliminating any possibility of intelligent opposition, which generates a counterweight between the powers and allow a rational balance between government and the people. Well, we find that as candidates for the Council of Citizen Participation and Social Control, only members of organizations that are not to say "survived" could participate. It is easy, analyzing in the light of discernment and as Ecuadorians that we live the so-called “Decade won”, to understand where that situation led us, the candidates for counselors of the Council of Citizen Participation and Social Control, were those who enjoyed the approval of the Executive, so that any winner in the competitions did not threaten the omnipotent will of the representative of the Executive, on the contrary, they would have a very good relationship of mandamás and servant. In a superfluous way I will explain what happens next, the directors are responsible for appointing the supervisory authorities, to the first authority of the Ombudsman's OfficePeople, Public Defender, General State Prosecutor and General Comptroller of the State, also those of the National Electoral Council, Contentious Electoral Tribunal and Judicial Council, and already more directly designate the first authority of the State Attorney General's Office and of the superintendencies from among the three proposals proposed by the President or President of the Republic, That is why in the present investigation I want to echo what many writers have strongly criticized, the creation of two new powers or functions as they are currently called, The Transparency and Social Control Function, and the Electoral Function.
