| Resumen : | La presente tesis se titula: “INCREMENTO DE LA SANCIÓN PARA LAS CONTRAVENCIONES DE MALTRATO Y MUERTE DE MASCOTAS Y ANIMALES DE COMPAÑÍA”, el cual se refiere a las agresiones que se ven expuestos los animales domésticos por parte de sus propietarios, o profesionales que se encargan del cuidado y a través de acciones u omisiones en las que se llega a deteriorar la integridad de un éstos animales en las que a veces realizan trabajos en los que realizan sobre esfuerzos, así como en otros casos se ven expuestos a lesiones en las que se atenta contra la vida de estos seres vivos, al tener en cuenta que los animales como miembros de la flora y la fauna que se ha reconocido en la Constitución de la República del Ecuador, así como en el Código Orgánico Integral Penal debe de reevaluar la sanción que se ha implementado para este tipo de conductas, al no ser tan severa se permite la reincidencia en este tipo de actos por parte del infractor sin llevar a la prevención y violentado los derechos de animales, además no se denota el arrepentimiento por parte del agresor. Considerando que por parte de sociedad existe una gran carencia de cultura y respeto hacia los animales, teniendo en cuenta que el ser humano se encuentra en una posición de superioridad en comparación de los animales, así también en los casos de violencia por parte de los agresores con la finalidad de buscar satisfacción de frustraciones o traumas en los buscan un escape a través del maltrato a los animales. |
