dc.descriptionThe importance of the object of study in this legal research is a problem derived from Public Law that is called: “THE ADMINISTRATIVE SILENCE PROVIDED IN THE ADMINISTRATIVE ORGANIC CODE AND ITS UNCONSTITUTIONALITY”, and is basedon the need to clarify what the Contitution of the Republic of Ecuador on the Right of Petition and the obligation of the Administration to provide a duly substantiated response in a timely manner, considering that the public function is at the service of the community and that public servants must fulfill their duties and obligations in a manner affective and efficient against the claims presented; likewise the Laws that regulate the Administrative Silence in our current regulations. In the development of this degree work has also shown that the Administrative Silence is in contradiction to the imperative mandate of the Challenge, as provided in the art. 173 of the Constitution that maintains, that the administered ones have the faculty to challenge the administrative acts, either before the Judicial seat or before the same Administration and the duty to give a response to every petition presented and the consequences that the omission could bring. Also in this thesis has shown that the Administrative Silence, enters into controversy with the principle of Supremacy of the Constitution, when applying by public officials the Administrative Organic Code where silence is regulated and not the Constitutional precepts, as the right of Petition and of Impugnation in relation to the requested petitions. In addition, it has been clearly shown that public servants misuse the legal figure of the Administrative Silence, by allowing the public servant not to resolve a petition or claim within the term stipulated by the law, demonstrating an attitude of negligence and ineffectiveness of the and even worse, that their attitude responds to commitments or 5 payments of favors for the benefit of the petitioners close to them, damaging the Public entity and the purposes of the people represented in the public administration. From what was developed in this legal study and administrative silence being inaplicable to enter into conflicto with the Right of Petition, Chellenge and Supremacy of the Constitution, a legal reform was proposed, in order to repeal the Administrative Silence, with itsdue foundation and with the conclusions and recommendations on the subject raised.es_ES
dc.description.abstractLa importancia del objeto estudio en esta investigación jurídica es un problema derivado del Derecho Público, que se denomina: “El SILENCIO ADMINISTRATIVO PREVISTO EN EL CODIGO ORGANICO ADMINISTRATIVO Y SU INCONSTITUCIONALIDAD”, y se sustenta en la necesidad de acatar lo que dispone la Constitución de la República del Ecuador acerca del Derecho de Petición y la obligación de la Administración de proporcionar una respuesta debidamente fundamentada y de manera oportuna, considerando que la función púbica se encuentra al servicio de la colectividad y que los servidores públicos deben cumplir sus deberes y obligaciones, de manera eficaz y eficiente frente a los reclamos presentados; así mismo las Leyes que regulan el Silencio Administrativo en nuestra normativa vigente. En el desarrollo de este trabajo de titulación también se ha demostrado que el Silencio Administrativo se encuentra en contradicción frente al mandato imperativo del Derecho de Impugnación, como lo dispone el art. 173 de la Constitución que sostiene, que los administrados gozan de la facultad de impugnar los actos administrativos, ya sea ante la sede Judicial o ante la misma Administración y el deber de dar una respuesta a toda petición presentada y las consecuencias que la omisión podría acarrear. Así mismo en esta tesis se ha demostrado que el Silencio Administrativo, entra en controversia con el principio de Supremacía de la Constitución, al aplicar por parte de los funcionarios públicos el Código Orgánico Administrativo donde se encuentra regulado la figura jurídica del silencio administrativo y no los preceptos Constitucionales, como el derecho de Petición y de Impugnación en relación a las solicitudes planteadas. Además claramente se ha evidenciado que los servidores públicos emplean de una manera errónea la figura jurídica del Silencio Administrativo, al permitirle al servidor público que 3 no resuelva una petición o reclamo en el término que la Ley estipula, demostrando una actitud de negligencia e inoperancia de los mismos y lo que es peor aún que su actitud responda a compromisos o pagos de favores en beneficio de los peticionarios allegados a ellos, perjudicando al ente Público y a los fines del pueblo representado en la Administración Pública. De lo desarrollado en este estudio jurídico y siendo el silencio administrativo inaplicable por entrar en pugna con el Derecho de Petición, Impugnación y el principio de Supremacía de la Constitución, se planteó una reforma jurídica, con el fin de derogar el Silencio Administrativo, con su debida fundamentación y con las conclusiones y recomendaciones sobre el tema planteado.es_ES
