dc.descriptionThe present research paper whose theme is "REFORMING ART 345 OF THE ORGANIC CODE OF THE JUDICIAL FUNCTION IN ORDER TO ESTABLISH AS A UNIQUE JURISDICTION OF INDIGENOUS JUSTICE THE JUDGMENT OF CRIMINAL COVENANTS" the present investigative thesis, reflects a scientific work, compared to the Legal and based on the criteria and arguments of the field results, with the purpose of demonstrating a work consiente of the problems and the reality of the indigenous communities of our Ecuador. For this reason I allow myself to make a brief general approach to the content of all the research with the aim that readers interested in reading or consulting in this thesis have an overview of the importance and content of the research work. In the Ecuadorian Criminal Law, different mechanisms and procedures have been envisaged for the resolution of conflicts, and referring to the evolution of criminal law, we have established different legal bodies, in order to maintain order and social peace. Consequently, the creation of normative bodies was indispensable and necessary. Thus, one of the most essential legal systems, such as the Organic Code of Judicial Function, will be dealt with later. On the other hand, it is important to state that our indigenous communities, peoples and nationalities have long owned and administered their own system of justice, based on their experience, ethical values, customs and traditions; In which justice is based on the application of sanctions in order that the individual who has committed a particular crime is inclined to admit their error, amend it and not do it again in the morning. The punitive system of indigenous justice, to a certain extent questionable, given that when any particular crime occurs within its territory, the accused are not subject to due process and, what is more, violates the principle of proportionality of the Penalty, thus opposing the current Constitution. The legislator, in issuing the Organic Code of Judicial Function, in article 345, establishes the competence of indigenous communities, peoples and nationalities to resolve conflicts. In relation to our investigation of a general way has been authorized to the indigenous justice the trial of crimes, without making any type of differentiation in matters nor classification of crimes; In such a way the procedure will be different from the Codes and laws of the ordinary justice, thus causing a serious social problem that affects the society. It is necessary and unavoidable that, without denying the possibility of the application of indigenous justice, it should be limited to the knowledge, prosecution and resolution of criminal offenses, which are slight and proportional to the sanctions that currently apply to the active subjects of the crime. The research problem is framed in the negative effects of the jurisdictional competence that the legislator has granted to indigenous justice, since it is not in complete harmony with the constitutional principles and institutions, as well as in order to respect and guarantee The subjective rights of the members of Ecuadorian society. It is a problem for the administration of justice, for the judges and for the victims, and for that reason it is necessary to solve this legal problem, on the other hand this investigation is within the respective limits. This thesis of Legal Research is structured as follows In the first place, different concepts related to indigenous justice, such as its objectives, definition of what indigenous law is, its characteristics, as well as a brief historical review of it, and then continue with a legal framework in which they are addressed Such as constitutional norms related to indigenous justice, customary law, the most common infractions in indigenous communities, which is the procedure to apply such justice, as well as the interference of ordinary justice in this field, To end up comparing the right to indigenous justice with that of other countries. Next, we find a doctrinal framework in which issues related to human rights are analyzed, their definition, characteristics and how to make them effective. We then continue to explain the methods and techniques used for the preparation of the present research, and thus to present the results obtained in the field research, this through survey, interviews and case analysis that have been given with respect To the problem investigated, after the field research was carried out, I verified the proposed objectives and contrasted the hypothesis, and then came to give the conclusions and recommendations that this problem merits and conclude by giving a draft of an indigenous justice law, which could Serve to bring it to the Assembly for its respective discussion and possible approval.es_ES
dc.description.abstractEl presente trabajo de investigación cuyo tema es “REFORMA AL ART. 345 DEL CÓDIGO ORGÁNICO DE LA FUNCIÓN JUDICIAL A FIN DE ESTABLECER COMO COMPETENCIA UNICA DE LA JUSTICIA INDIGENA EL JUZGAMIENTO DE CONTRAVENCIONES PENALES”. la presente tesis investigativa, refleja un trabajo científico, comparado con la parte jurídica y basado con los criterios y argumentos de los resultados de campo, con la finalidad de demostrar un trabajo consiente de la problemática y la realidad de las Comunidades indígenas de nuestro Ecuador. Por tal razón me permito hacer un breve enfoque general del contenido de toda la investigación con el objetivo que los lectores que se interesen leer o consultar en esta tesis tengan una visión general de la importancia y el contenido del trabajo investigativo. En el régimen Penal Ecuatoriano se han previsto distintos mecanismos y procedimientos para la solución de conflictos, y refiriéndonos a la evolución del derecho penal, tenemos que se han establecido distintos cuerpos legales, a fin de mantener el orden y la paz social. Por consiguiente la creación de cuerpos normativos fué indispensable y necesaria, surge así uno de los más esenciales ordenamientos jurídicos, como lo es, el Código Orgánico de la Función Judicial, que más adelante trataremos. Por otra parte es importante manifestar que nuestras comunidades, pueblos y nacionalidades indígenas en nuestro país, desde hace mucho tiempo atrás, poseen y administran su propio sistema de justicia, el mismo que está basado en su experiencia, valores éticos, costumbres y tradiciones; en la cual la justicia se fundamenta en la aplicación de sanciones con el objetivo de que el individuo que haya cometido algún determinado delito sea proclive en admitir su error, enmendar el mismo y no volver a realizarlo en el mañana. Siendo el sistema punitivo de la justicia indígena, en cierta medida cuestionable, dado que al surgir cualesquier delito determinado dentro de su territorio, a los imputados no se los somete al debido proceso y lo que es más, se vulnera el principio de proporcionalidad de la pena, contraponiéndose así a la Constitución en vigencia. El legislador al dictar el Código Orgánico de la Función Judicial, en el artículo 345, establece la competencia que tienen las comunidades, pueblos y nacionalidades indígenas para resolver conflictos. En relación a nuestra investigación de manera general se le ha facultado a la justicia indígena el juzgamiento de delitos, sin hacer ningún tipo de diferenciación en materias ni clasificación de delitos; en tal virtud el procedimiento será distinto al de los Códigos y leyes de la justicia ordinaria, causando así un grave problema de carácter social que afecta a la sociedad. Es preciso e ineludible, que sin negar la posibilidad de la aplicación de la justicia indígena, ésta se debe limitar al conocimiento, juzgamiento y resolución de contravenciones penales, que son leves y proporcionales a las sanciones que en la actualidad aplican a los sujetos activos del delito. El problema de investigación se enmarca en los efectos negativos que causa la competencia jurisdiccional que el legislador le ha otorgado a la justicia indígena, dado que no se halla en completa armonía con los principios e instituciones constitucionales, así como en orden al respeto y garantía de los derechos subjetivos de los integrantes de la sociedad ecuatoriana. Es un problema para la administración de justicia, para los juzgadores y para las víctimas, y por ello es necesario resolver este problema de carácter jurídico, por otra parte esta investigación está dentro de los marcos respectivos. La presente tesis de Investigación Jurídica se encuentra estructurada de la siguiente manera En primer lugar diferentes conceptos relacionados, con la justicia indígena, como cuáles son sus objetivos, definición de lo que es el derecho indígena, sus características, así como una breve reseña histórica de esta, para luego continuar con un marco jurídico en cual se abordan temas como, las normas constitucionales relacionadas con la justicia indígena, lo relacionado con el derecho consuetudinario, las infracciones más comunes en las comunidades indígenas, cual es el procedimiento para aplicar dicha justicia, así como también la injerencia de la justicia ordinaria en este campo, para terminar comparando el derecho a la justicia indígena con el de otros países. Seguidamente encontramos un marco doctrinario en donde se analizan temas relacionados con los derechos humanos, su definición, características y la forma de cómo hacerlos efectivos. Luego se continua explicando cuales fueron los métodos y las técnicas utilizadas para la elaboración de la presente investigación, y con ello exponer los resultados obtenidos en la investigación de campo, esto a través de encuesta, entrevistas y análisis de casos que se han dado con respecto al problema indagado, luego de realizada la investigación de campo he verificado los objetivos planteados y he contrastado la hipótesis planteada, para luego llegar a dar las conclusiones y recomendaciones que este problema amerita y concluir dando un borrador de una ley de justicia indígena, que podría servir para llevarla a la Asamblea para su respectivo debate y posible aprobación.es_ES
