Título : Exigencia de renovación de garantías de fiel cumplimiento y buen uso de anticipo en obras terminadas con entrega recepción definitiva, real o presunta en la contratación pública

Resumen : La Ley exige en el momento suscripción de los contratos públicos, a los contratistas que otorguen las garantías que correspondan, siendo aquellas una relación extracontractual entre el Estado y una compañía de seguros que, dentro de su actividad contrata con un contratista, la adopción de un riesgo, siendo el Estado el beneficiario. El Art. 73 de la Ley Orgánica del Sistema Nacional de Contratación Pública, como garantías establece: 1. Garantía incondicional, irrevocable y de cobro inmediato, otorgada por un banco o institución financiera establecidos en el país o por intermedio de ellos; 2. Fianza instrumentada en una póliza de seguros, incondicional e irrevocable, de cobro inmediato, emitida por una compañía de seguros establecida en el país; 3. Primera hipoteca de bienes raíces, siempre que el monto de la garantía no exceda del sesenta (60%) por ciento del valor del inmueble hipotecado, según el correspondiente avalúo catastral correspondiente; 4. Depósitos de bonos del Estado, de las municipalidades y de otras instituciones del Estado, certificaciones de la Tesorería General de la Nación, cédulas hipotecarias, bonos de prenda, Notas de crédito otorgadas por el Servicio de Rentas Internas, o valores fiduciarios que hayan sido calificados por el Directorio del Banco Central del Ecuador; y, 5. Certificados de depósito a plazo, emitidos por una institución financiera establecida en el país, endosados por valor en garantía a la orden de la Entidad Contratante y cuyo plazo de vigencia sea mayor al estimado para la ejecución del contrato.” Son tres las modalidades de garantías que establece la Ley Orgánica del Sistema Nacional de Contratación Pública, que son: la garantía de fiel cumplimiento, que tiene como finalidad asegurar el cumplimiento oportuno y eficaz de las relaciones a favor de la entidad pública y de terceros; la garantía de buen uso y anticipo, éste debe ser otorgada por el contratista en caso de que por la naturaleza de la contratación o forma de pago, la entidad entregue un anticipo para el cumplimiento del contrato, con la finalidad de asegurar el 100 % de los fondos entregado por el Estado o sus entidades; y, la garantía técnica para ciertos bienes, que para ciertos contratos de adquisición, provisión o instalación de equipos, maquinarias o vehículos, tienen la finalidad de asegurar la calidad y buen funcionamiento. Es el caso que un contratista otorgue las garantías para la realización de la obra, la Ley Orgánica del Sistema Nacional de Contratación Pública prevé, en el Art. 77, que en los contratos de ejecución de obras, la garantía de fiel cumplimiento se devolverá al momento de la entrega recepción definitiva, real o presunta. En los demás contratos, las garantías se devolverán a la firma del acta recepción única o a lo estipulado en el contrato. Pero se da el caso que la institución del Estado no ha cancelado los valores por la terminación de contrato una vez que ya se entregue la obra terminada y se tenga el acta de recepción definitiva a lo que prescribe el contrato, y éste por la ausencia de planificación y de políticas de contratación pública ha derivado en discrecionalidad exigir al contratista que renove las garantías de fiel cumplimiento y buen uso de anticipo, trayendo un gran perjuicio al contratista, realizar este trámite hasta que el Estado pague sus obligaciones por la terminación del contrato, con lo cual va en contra de los derechos de estas personas, porque el Estado y las entidades públicas se atribuyen obligaciones que no están establecidas en la Ley, violando con ello el Art. 226 de la Constitución de la República del Ecuador, que "Las instituciones del Estado, sus organismos, dependencias, las servidoras o servidores públicos y las personas que actúen en virtud de una potestad estatal ejercerán solamente las competencias y facultades que les sean atribuidas en la Constitución y la ley. Tendrán el deber de coordinar acciones para el cumplimiento de sus fines y hacer efectivo el goce y ejercicio de los derechos reconocidos en la Constitución"
Descripción : The Act requires at the time underwriting public contracts, contractors who provide the guarantees that apply, with those a contractual relationship between the State and an insurance company, within its business contracts with a contractor, the adoption of a risk, being the beneficiary State. Article 73 of the Organic Law of the National Public Procurement System as guarantees provides: 1. unconditional, irrevocable and immediate payment, issued by a bank or financial institution established in the country or through them Assurance; 2. First Mortgage real estate, provided that the amount of the guarantee does not exceed sixty (60%) percent of the value of the mortgaged property, according to the appropriate corresponding property valuation; 4. Deposits of government bonds, municipalities and other state institutions, certifications of the General Treasury of the Nation, mortgage bonds, pledge bonds, credit notes issued by the Internal Revenue Service, or trust securities that have They have been qualified by the Board of the Central Bank of Ecuador; and, 5. certificates of deposit issued by a financial institution established in the country, endorsed by value in order to guarantee the Contracting Entity and whose validity period is greater than estimated for the execution of the contract. " There are three forms of guarantees established by the Organic Law of the National Public Procurement System, which are: performance bond, which aims to ensure timely and effective implementation of relations in favor of the public entity and third parties; ensuring proper use and advance it must be granted by the contractor in case the nature of the contract or payment, the entity to deliver an advance for the fulfillment of the contract, in order to ensure 100% the funds awarded by the State or its institutions; and technical guarantee for certain goods, which for certain contracts for procurement, supply or installation of equipment, machinery or vehicles are designed to ensure the quality and smooth operation. It is the case that a contractor granting guarantees for the realization of the work, the Organic Law of the National Public Procurement System provides in Art. 77, which contracts execution of works, the performance bond shall be returned to delivery time short, real or alleged reception. In other contracts, guarantees will be returned to the signing of the minutes only reception or stipulated in the contract. They have the duty to coordinate actions for the fulfillment of its objectives and fulfill the enjoyment and exercise of the rights recognized in the Constitution"
