dc.descriptionThe present research paper whose theme is "REFORM OF ARTICLE 463 OF THE PENAL COMPREHENSIVE ORGANIC CODE IN ORDER TO ESTABLISH THE JUDICIAL AUTHORIZATION FOR THE EXTRACTION OF BODY FLUIDS TO THE PROCESSED IN SEXUAL AND AGAINST LIFE", is the purpose of this Work Of investigation is oriented to the juridical and critical analysis of the procedures and extraction of corporal fluids to the processed one, with the intention of not leaving in defenseless the victim in the different sexual crimes, that in principle must be fundamental rights as established in our Magna Carta . The current criminal legislation in Ecuador has evolved in terms of several of the procedural and constitutional principles within which I consider one of the most relevant is the integral reparation of the damage caused to the victim, and this is how our Constitution De The Republic of Ecuador in its Title II of the Rights, Chapter VI of the Rights of Freedom, Article 66 recognizes and guarantees to the people, and it is here that in its numeral one expresses "The right to inviolability of life. There will be no death penalty, "so in its number three expresses very clearly" the right to personal integrity, and in paragraph A mentions the physical, psychological, moral and sexual integrity of the victim. In establishing judicial authorization for the extraction of body fluids from the defendant, the right to due process is being guaranteed and the victims are not violated, as currently our Code of Criminal Integral is established in its article 463 on the Obtention of Samples, when expressing that: "For the obtaining of samples of corporal fluids, organic and genetic-molecular components the following rules will be followed: 1. Tests of a biological nature, blood draws, objects in the body or the like may not be carried out if there is fear of impairment in the health and dignity of the person being examined. 2. When the examination is to be carried out on victims of offense against sexual integrity or in a girl, boy or adolescent, the necessary measures will be taken according to their age and gender to protect their dignity and physical and psychological integrity. The exams will be practiced with strict conditions of confidentiality and respect for privacy. Unless it is essential, it shall be prohibited to submit the person to the same examination or legal medical examination again. Health professionals conducting these examinations shall be obliged to keep the evidence found in safety conditions, which shall be immediately delivered to the personnel of the specialized specialized system of investigation, forensic medicine and forensic sciences, and shall give early testimony or may Be received by video conferences in accordance with the rules of this Code. The present thesis of Legal Investigation is structured as follows: In the first place a Conceptual Framework, which includes concepts and definitions such as sexual offenses, judicial authorization, among other concepts that will give greater emphasis to the proposed topic; A Doctrinal Framework, which covers the doctrines of writers and scholars on the application of regimes. Legal Framework, which includes the analysis of the Constitution of the Republic of Ecuador, the Organic Comprehensive Criminal Code, the Organic Code of Judicial Function and then we have a Comparative Legislation, since it served to me to carry out an analysis of the matter of other countries And to extract the most positive. dc.description.abstractEl presente trabajo de investigación cuyo tema es “REFORMA AL ARTÍCULO 463 DEL CÓDIGO ORGÁNICO INTEGRAL PENAL A FIN DE ESTABLECER LA AUTORIZACIÓN JUDICIAL PARA LA EXTRACCIÓN DE FLUIDOS CORPORALES AL PROCESADO EN LOS DELITOS SEXUALES Y CONTRA LA VIDA” es así que el objetivo de este Trabajo de investigación está orientada al análisis jurídico y crítico de los procedimientos y extracción de fluidos corporales al procesado, con el ánimo de no dejar en indefensión a la víctima en los diferentes delitos sexuales, que por principio deben ser derechos fundamentales como lo establece nuestra Carta Magna. La actual legislación penal en el Ecuador ha evolucionado respecto a lo que significa varios de los principios procedimentales y constitucionales dentro de los cuales considero que uno de los más relevantes es la reparación integral del daño causado a la víctima, y es así que nuestra Constitución De La República Del Ecuador en su Título II de los Derechos, Capítulo VI de los Derechos De Libertad, artículo 66 reconoce y garantizará a las personas, y es aquí que en su numeral uno expresa “El derecho a la inviolabilidad de la vida. No habrá pena de muerte”, así también en su numeral tres expresa muy claramente “el derecho a la integridad personal, y en el literal A menciona La integridad física, psíquica, moral y sexual, de la víctima. Al establecer la autorización judicial para la extracción de fluidos corporales al demandado se está garantizando el derecho del debido proceso y no se vulnera los mismos a la víctimas, como en la actualidad nuestro Código Orgánico Integral Penal lo establece en su artículo 463 sobre la Obtención de muestras, al expresar que: “Para la obtención de muestras de fluidos corporales, componentes orgánicos y genético-moleculares se seguirán las siguientes reglas: 1. No se podrá realizar pruebas de carácter biológico, extracciones de sangre, de objetos situados en el cuerpo u otras análogas, si se teme menoscabo en la salud y dignidad de la persona objeto de examen. 2. Cuando el examen deba realizarse en víctimas de infracción contra la integridad sexual o en una niña, niño o adolescente, se tomarán las medidas necesarias en función de su edad y género para precautelar su dignidad e integridad física y psicológica. Los exámenes se practicarán con estrictas condiciones de confidencialidad y respeto a la intimidad. Salvo que sea imprescindible, se prohibirá someterle a la persona nuevamente a un mismo examen o reconocimiento médico legal. Los profesionales de la salud que realicen estos exámenes estarán obligados a conservar los elementos de prueba encontrados en condiciones de seguridad, que serán entregados inmediatamente al personal del Sistema especializado integral de investigación, de medicina legal y ciencias forenses, y deberán rendir testimonio anticipado o podrán ser receptados mediante video conferencias de acuerdo con las reglas del presente Código. Se ve muy claramente que la extracción de estas muestras solo pueden ser extraídas con el consentimiento del agresor si este lo deseara, lo cual no garantiza los derechos de la víctima y se vulneran los mismos. Hay que tomar muy en consideración que en la actualidad los delitos sexuales o contra la vida, son sancionados con penas muy severas como así lo establece nuestro Código Orgánico Integral Penal, pero al momento de dar potestades a la Fiscalía General del Estado para el inicio de la Instrucción Fiscal, se vulneran algunos derechos, ya que no se entregan todos los medios necesarios a esta institución para poder investigar el caso y presentar una prueba fundamentada sin tomar en consideración los derechos de la víctima, que como lo observamos anteriormente nuestra Carta Magna los reconoce como principales y fundamentales dentro de un proceso. La presente tesis de Investigación Jurídica se encuentra estructurada de la siguiente manera: En primer lugar un Marco Conceptual, que comprende conceptos y definiciones como tenemos delitos sexuales, autorización judicial, entre otros conceptos que darán mayor realce al tema propuesto; un Marco Doctrinario, que abarca las doctrinas de los tratadistas y estudiosos sobre la aplicación de los regímenes. Marco Jurídico, que comprende al análisis de la Constitución de la República del Ecuador, el Código Orgánico Integral Penal, el Código Orgánico de la Función Judicial y luego tenemos una Legislación Comparada, ya que me sirvió para realizar un análisis de la materia de otros países y poder extraer lo más positivo. En segundo lugar el trabajo investigativo comprende un estudio de campo en el que se desarrollan encuestas y entrevistas a los conocedores del derecho en el que me ayudan a determinar o contrastar los objetivos e hipótesis planteada. En tercer lugar luego del análisis de la investigación de campo se procedió a las conclusiones y recomendaciones y por último a una propuesta jurídica necesaria para la solución del problema planteado.es_ES
