Resumen : En el juzgamiento de las contravenciones de tipo flagrante, al aplicar la RESOLUCIÓN N°01-2016 DEL PLENO DE LA CORTE NACIONAL DE JUSTICIA, SE VULNERA EL PRINCIPIO CONSTITUCIONAL, de la presunción de inocencia del presunto contraventor, ya que al interponer el recurso de apelación, el presunto contraventor queda privado de su libertad, violando así el principio constitucional de la presunción de inocencia. Resulta inconstitucional debido a que si una persona es sorprendida en una contravención flagrante, la audiencia de juzgamiento será en un lapso de 24 horas, que es el tiempo que está detenido el contraventor, pero resulta que en el momento que el juez dicta sentencia (no ejecutoriada), el contraventor tiene 3 días para impugnar la resolución del juez a través del recurso de apelación, pero la interposición de este recurso según la RESOLUCIÓN N°01-2016 DEL PLENO DE LA CORTE NACIONAL DE JUSTICIA, no implica la libertad del contraventor, el problema radica en este lapso de la interposición del recurso de apelación, ya que se está violando la presunción de inocencia del contraventor al mantenerlo con una pena privativa de libertad; y en ese trayecto que lo mantienen detenido si el contraventor trabaja, puede incluso perder su trabajo al no presentarse en la institución que labora, por ello considero que en ese trayecto que dura la tramitación del recurso de apelación, al contraventor pueda sustituírsele la prisión preventiva mediante cualquiera de las modalidades alternativas o sustitutivas 3 (caución), tal como lo estipula el art 543 del Código Orgánico Integral Penal (COIP): La caución se dispondrá para garantizar la presencia de la persona procesada y suspenderá los efectos de la prisión preventiva. La caución podrá consistir en dinero, póliza, fianza, prenda, hipoteca o carta de garantía otorgada por una institución financiera. La persona procesada podrá rendir caución con su dinero o bienes o con los de un garante”. La presunción, es el conocimiento que se adquiere o la inferencia o deducción que en virtud del razonamiento extrae el juzgador del conjunto de indicios, en relación con las demás probanzas que obren dentro del proceso, y que lo llevan a concluir que el hecho desconocido es cierto. Tomando en cuenta que el Libro Preliminar del Código Orgánico General de Procesos (COIP), en el Capítulo Segundo, trata sobre los Principios Rectores y Garantías en el Proceso Penal. Y el Art. 5, señala los 21 principios procesales y entre ellos, el de inocencia. “Artículo 5.- Principios procesales.- El derecho al debido proceso penal, sin perjuicio de otros establecidos en la Constitución de la República, los instrumentos internacionales ratificados por el Estado u otras normas jurídicas, se regirá por los siguientes principios: (…) 3: “Duda a favor del reo: la o el juzgador, para dictar sentencia condenatoria, debe tener el convencimiento de la culpabilidad penal de la persona procesada, más allá de toda duda razonable” (…) 4. Inocencia: toda persona mantiene su estatus jurídico de inocencia y debe ser tratada como tal, mientras no se ejecutoríe una sentencia que determine lo contrario”Hay que señalar, que en atención a este principio, el procesado no está obligado a presentar prueba alguna que demuestre su inocencia, y por el contrario ordena a las autoridades judiciales competentes, la demostración de culpabilidad del procesado; recordando que para dictar sentencia condenatoria. De tal manera que el principio constitucional de presunción de inocencia, exige que el procesado sea tratado como inocente en la sustanciación del proceso; esto es reconocer el derecho a permanecer en libertad durante el proceso, o sea a considerar que el procesado no puede ser sometido a una pena, y por tanto no puede ser tratado como culpable, hasta que no se dicte la sentencia firme de condena.

The presumption is the knowledge that is acquired or inference or deduction under the reasoning draws judge the body of evidence in relation to other proofs which are held within the process, and that lead him to conclude that the unknown fact is true. Given that the Preliminary Book of the Code General Process (COIP), in Chapter Two, addresses the Guiding Principles and Guarantees in Criminal Proceedings. And Art. 5, points 21 and including procedural principles, that of innocence. "Section 5.
