Resumen : Al dejar un hombre de lado su responsabilidad de velar por elbienestar de sus hijos e hijas, los está privando de su afecto, de su apoyo parasatisfacer las necesidades materiales y espirituales. Por eso es necesariohacer valer la responsabilidad de sus progenitores. La protección integral de la niñez y la adolescencia ha sido unapreocupación constante del Estado costarricense y ha incluido esfuerzoslegislativos, tanto en el nivel constitucional y legal, como en el marcosupranacional regulado mediante Convenciones Internacionales. El hacerposible que toda persona menor de edad tenga una filiación establecida esparte de estas obligaciones morales asumidas por el Estado. La paternidad y maternidad responsable es aquella que tienen los padres decumplir con todos los goces y las responsabilidades en la crianza y educaciónde sus hijos e hijas. Ello trasciende el reconocimiento de su paternidadmediante la acción de la prueba de filiación o la garantía del sustentoeconómico. Las parejas que pretenden procrear deben estar conscientes que es una responsabilidad, ya que estos deben realizarse controles prenatales para evitar problemas posteriores congénitos para el bebe y riesgos en el embarazo para la madre. Los controles prenatales, de embarazo y de maternidad generan varios gastos económicos, los cuales deben ser solventados por el padre, el Código de la Niñez y Adolescencia menciona que La mujer embarazada tiene derecho desde el momento de la concepción, a alimentos para la atención de sus necesidades de alimentación, salud, vestuario, vivienda, atención del parto, puerperio y durante el período de lactancia por un tiempo de doce meses contados desde el nacimiento del hijo o hija; si la criatura muere en el vientre materno, o el niño o niña fallece luego del parto, la protección a la madre subsistir hasta por un periodo no mayor de doce meses contados desde que se produjo la muerte fetal o del niño o niña; sin embargo no lo establece los gastos de preconcepción y como se calculara el pago justo y adecuado para todos los gastos que genere el embarazo y postparto. El presente trabajo, trata de analizar estos temas y dar una posible solución a estos vacíos legales
Descripción : Leaving aside a man of his responsibility to ensure the welfare of their children, he is deprived of his affection, his support to meet the material and spiritual needs. Therefore it is necessary to enforce the responsibility of their parents. The comprehensive protection of children and adolescents has been a constant concern of the Costa Rican State and included efforts Legislative both, as in the supranational framework regulated by international conventions on constitutional and legal level. Doingpossible that all minor has an established affiliation ispart of these moral obligations assumed by the State. The responsible parenthood is that parents have to comply with all the joys and responsibilities for the upbringing and education of their children. This goes beyond the recognition of paternity by the action of the paternity test or guarantee of financial support. Couples who intend to have children must be aware that it is a responsibility, as these prenatal birth should be made to avoid further problems and risks for the baby during pregnancy for the mother. Prenatal care, pregnancy and maternity generate several economic costs, which must be borne by the father, the Code on Children and aolescencia mentions that the pregnant woman is entitled from the moment of conception, to food to the attention of their needs for food, health, clothing, housing, care during childbirth, postpartum and during lactation for a period of twelve months after the birth of the child; if the child dies in the womb, or the child dies after birth, the mother's protection to survive for a period not exceeding twelve months from the occurrence of fetal or child death; however not established preconception and expenses as fair and appropriate payment will be calculated for all costs incurred pregnancy and postpartum. This paper tries to analyze these issues and give a possible solution to these loopholes
