Resumen : El tema motivo de investigación, es un problema que atañe a toda la realidad ecuatoriana, considerando que una gran parte de la población de esta República no posee vivienda propia y que habitan en viviendas de alquiler, después de la celebración de un contrato de arrendamiento, y a pesar de que dicho contrato se encuentra normado por la Ley de Inquilinato, resulta muy fácil incurrir a la violación de las normativas existentes. La sociedad ecuatoriana se ve inmersa en un sistema capitalista, cuya función y filosofía considero una herramienta potencial de desarrollo, pero el problema radica en la tergiversación de este orden social y económico que deriva del usufructo de la propiedad privada, pues se han alterado de forma desmesurada todos los factores que determinan el buen funcionamiento de este sistema. El Estado en su jurisdicción ha tratado de regular ciertas normativas evidenciadas en la Ley de Inquilinato que pretenden lograr una justa retribución económica por parte de los arrendatarios hacia el bien inmueble arrendado, estipulando también así obligaciones y condiciones en las que se debe encontrar el bien, para colocarse como vivienda rentera. Hago énfasis en el precio, porque a diario se puede encontrar en las calles ecuatorianas los anuncios y avisos de que se rentan habitaciones, casas, cuartos, departamentos a unos precios exorbitantes, que en muchos de los casos no brindan las condiciones adecuadas para el desarrollo integral de un individuo, lo lamentable es saber a ciencia cierta que existen pocas casas inscritas en el municipio como renteras, y que poseen el avalúo correspondiente para ser fijado el precio de alquiler. El mismo que se lo realiza de forma minuciosa, verificando si dicho predio es o no apto para ser inscrito como una casa rentera, el problema entonces radica, en la inobservancia de la Ley, al no cumplir con esta disposición los arrendadores incurren y atentan contra uno de los derechos de los ciudadanos que garantiza la Constitución de la República del Ecuador, el de gozar de una vivienda digna. La Ley de inquilinato estipula todas las normativas para celebrar un contrato de arrendamiento justo tanto para el arrendador como para el arrendatario, es entonces cuando surge la inquietud, de por qué la existencia de abuso por parte de los arrendadores sobre todo en cuestiones económicas, es decir el precio del inmueble en alquiler y el alza del mismo cada cierto tiempo (1 año), cuando en realidad son cada dos años o por la implementación de mejoras a la vivienda según el Art. 21 de dicha Ley, cuyo incumplimiento tiene sanción, entonces se concluye que no existe una correcta aplicabilidad de las disposiciones, o, un desconocimiento total o parcial de la población en cuanto a sus derechos y obligaciones
