Título : Insuficiencia de la ley de aguas al garantizar el derecho humano del agua potable.

Resumen : ―El Derecho Humano al Agua Potable‖, es un derecho y una garantía inherente a todo ser humano, y para esto específicamente nuestra Constitución establece lo siguiente: Art. 12.- El derecho humano al agua es fundamental e irrenunciable. El agua constituye patrimonio nacional estratégico de uso público, inalienable, imprescriptible, inembargable y esencial para la vida. Para el efecto se parte de una consideración general de la importancia de los recursos hídricos como elementos vitales para la sobrevivencia del ser humano en la sociedad y para el desarrollo de actividades económicas, de salubridad y para la satisfacción de necesidades en general. El elemento de la naturaleza AGUA, tiene primordialmente un significado místico, mágico, ya que es fuente de vida, de creación, es un milagro que demuestra la existencia palpable de la vida. El Derecho Humano al Agua Potable es un derecho colectivo, ya que el agua es un recurso natural, que pertenece a la naturaleza, al medio ambiente. Los consumidores tienen derecho a beber agua potable, salubre y de buena calidad. El agua potable es un recurso vital para el ser humano y el derecho del agua potable y al saneamiento forma parte integrante de los derechos humanos oficialmente reconocidos en los diferentes eventos internacionales. Nunca se ha considerado el agua como lo que realmente es: un bien común universal, patrimonio vital de la humanidad. El acceso al agua debe ser considerado como un Derecho básico, individual y colectivamente inalienable. Sobre esto la Ley de Aguas menciona; ―Si más de cinco personas tuvieran derecho de aprovechamiento común de aguas, se constituirán en Juntas Administradoras de agua potable. Sus estatutos, aprobados por el Consejo Nacional de Recursos Hídricos, determinarán la organización y funcionamiento de los mismos, así como el reparto, explotación y conservación de las aguas. El Consejo Nacional de Recursos Hídricos intervendrá en todos los conflictos que se suscitaren en los directorios de aguas o juntas administradoras de agua potable y arbitrará las medidas convenientes a fin de que éstos cumplan sus funciones y atribuciones. Y es que en la actualidad y en nuestra localidad específicamente se trasgrede nuestro derecho al agua potable a diario, puesto que sin motivo y sin aviso alguno, nos privan de este elemento vital. De ahí la necesidad de realizar una investigación jurídica- social sobre la insuficiencia de la Ley de Aguas respecto a este derecho.
Descripción : "The human right to drinking water", is a right and an inherent to every human being, and for this warranty specifically our Constitution sets forth the following: article 12.-the right human water is fundamental and indispensable. Water is a strategic national heritage of using public, inalienable, imprescriptible, unattachable and essential for life. For the effect are based on a general consideration of the importance of water resources as vital to the survival of the human being in society and for the development of economic activities, health and the satisfaction of needs in general. The element of water nature, primarily has a mystical, magical, meaning since it is source of life, of creation, is a miracle that palpable evidence of life. The human right to drinking water is a collective right, since water is a natural resource that belongs to nature, environment-friendly. Consumers have the right to drinking water potable, safe and of good quality. Drinking water is a vital resource for human beings and the right to drinking water and sanitation as an integral part of human rights officially recognized in different international events. Never has been considered water as what it really is: a universal common good, vital heritage of humanity. Access to 5 water should be considered as a basic, inalienable individual and collective right. On this the water law mentions; "If more than five people had a right to common use of water, will provide in joint managers of drinking water. Its statutes, approved by the National Council of water resources, will determine the Organization and operation of, as well as the distribution, exploitation and conservation of the waters. The national water resources Council willintervene in all the conflicts that arise in water or potable water administrative boards directories and contents and 14(bis) will provide suitable measures to ensure that these comply with its functions and powers. And it is that nowadays, in our town, specifically transgresses our right to clean water every day, that without reason and without any notice, we deprive of this vital element. Hence the need for a legal research - social about the inadequacy of the water law with respect to this right.
