Resumen : Este ha sido un tema que mucha polémica e incertidumbre ha causado en lo referente a la “Declaración Patrimonial” que los agentes económicos del país, o sea los ciudadanos ecuatorianos, deben efectuar cuando su patrimonio sea superior a los doscientos mil dólares estadounidenses, cuando son ciudadanos solteros y cuatrocientos mil dólares norteamericanos, cuando exista sociedad conyugal o unión de hecho; tema éste de inmensa preocupación que me ha obligado a realizar un análisis exhaustivo, para encontrar la real dimensión y propósito del Gobierno, al obligarnos a todos quienes residimos en el Ecuador y sobrepasen los montos señalados a realizar tal declaración. Desde este punto de vista creo en la ineludible necesidad, como estudiante de Derecho, de contribuir, a esclarecer y tratar de corregir y enmendar tal despropósito jurídico, que no hace otra cosa que atentar contra la privacidad de las personas, pues en ninguna parte de la Ley Orgánica de Régimen Tributario, ni en el Código Tributario, se prevé la confidencialidad de la información proporcionada al Servicio de Rentas Internas, tan sólo ha sido un enunciado verbal por parte del Director Nacional del Servicio de Rentas Internas, al pronunciarse en este sentido. Al realizar un estudio prolijo y minucioso del Derecho Tributario, de la Ley de Régimen Tributario Interno, de su Reglamento y de las reformas mediante Decreto Presidencial, en concordancia con la Constitución de la República del Ecuador y el Código Penal, me he visto en la imperiosa necesidad de aportar con mi trabajo investigativo a este hermoso campo del saber socio-jurídico, no sólo para hacer una investigación formativa sobre el actual problema de la declaración patrimonial, sino para analizar los efectos posteriores y preferentemente, para buscar alternativas de solución a este álgido problema, que puede en el futuro convertirse en un serio problema con daños irreparables. Estimo que la presente investigación jurídica se encuentra plenamente justificada conforme a derecho, pues es deber esencial de quienes nos venimos formando en el campo profesional del derecho, inmiscuirnos de manera sistematizada y profunda en los diversos problemas de tipo jurídico que afectan a nuestra sociedad. La importancia y actualidad de la problemática planteada, se justifica jurídicamente al llevar a cabo el presente trabajo, por cuanto estudiaremos una de las más importantes y de actualidad como es la Institución del Derecho Tributario Interno, con la siguiente problemática “LA DECLARACIÓN JURAMENTADA PATRIMONIAL DE BIENES VULNERA EL DERECHO CONSTITUCIONAL DE PRIVACIDAD DE LAS PERSONAS POR PARTE DEL SERVICIO DE RENTAS INTERNAS POR LO QUE ES NECESARIO QUE SE REFORME LA LEY DE RÉGIMEN TRIBUTARIO INTERNO.” analizando cada una de las implicaciones jurídicas, estudio que representa importancia jurídica, que sirve para nuestra formación profesional y para el ejercicio de la abogacía. La Constitución de la República del Ecuador, reconoce y otorga derechos fundamentales a las personas, como también tipifica y sanciona las conductas que los vulneran a través de su ordenamiento jurídico competente en razón del delito o contravención. El Servicio de Rentas Internas (SRI), por Decreto Ejecutivo Número 1051, obliga a los ciudadanos ecuatorianos a la declaración patrimonial de bienes cuyo patrimonio económico en forma personal pase los doscientos mil dólares y en la sociedad conyugal o unión de hecho sobrepase los cuatrocientos mil dólares de los Estados Unidos de Norteamérica, lo que atenta contra los principios de dignidad y privacidad, establecidos en la Constitución de la República del Ecuador y el Código Penal Ecuatoriano, ya que esta información puede ser mal manejada y provocar que las personas sean plagiadas. El Decreto Ejecutivo mencionado del Reglamento para la Aplicación de la Ley Orgánica de Régimen Tributario Interno, en su Artículo 65, Inciso Segundo, contraviene expresas disposiciones contenidas en la Constitución de la República del Ecuador y del Código Penal Ecuatoriano
Descripción : This has been an issue that a lot of controversy and uncertainty has caused regarding the "Equity Statement" that operators in the country, or is Ecuadorian citizens, must make when your property is greater than the U.S. dollar, two hundred thousand, when unmarried American citizens and four hundred thousand dollars, where there is spousal or common-law partnership; this issue of immense concern that has forced me to do a thorough analysis to find the actual size and purpose of the Government to compel all who reside in Ecuador and exceed the amounts indicated to make such a declaration. From this point of view I believe in the imperative, as law students, to contribute, to clarify and try to correct and amend this legal nonsense that does nothing to undermine the privacy of individuals, as nowhere Law of Taxation or the Tax Code provides for the confidentiality of information provided to the Internal Revenue Service has only been a verbal statement by the National director of the Internal Revenue Service a ruling to that effect . When a lengthy and detailed study of the Tax Law, the Law on Internal Taxation of the Rules and reforms by Presidential Decree, in accordance with the Constitution of the Republic of Ecuador and the Criminal Code, we have seen in the urgent need to bring our research work in this beautiful field of socio-legal knowledge, not only to make a formative research on the current problem of the financial statement, but to analyze the aftereffects and preferably, to seek alternative solutions to this critical problem, which may in the future become a serious problem with irreparable damage. We believe that the present legal research is fully justified under the law, it is essential duty of us who come form in the professional field of law, meddling and deeply systematized in various legal problems that affect our society. The importance and relevance of the issues raised, is legally justified in carrying out this work, since we study one of the most important and topical as the Institution of Domestic Tax Law, with the following problem "The requirement of declaration assets from the Internal Revenue Service (IRS), which violates the constitutional principle of dignity and privacy of individuals ", analyzing each of the legal implications, studio representing legal significance, used to our training and for practice of law. The Constitution of the Republic of Ecuador recognizes and gives fundamental rights to individuals, as well as defines and punishes conduct that violated through its competent legal system because of the offense or contravention. The Internal Revenue Service (IRS), by Executive Order No. 1051, forcing Ecuadorians to the declaration of assets whose economic assets personally pass two hundred thousand dollars and the conjugal union or indeed exceed four hundred thousand dollars of the United States, which goes against the principles of dignity and privacy, enshrined in the Constitution of the Republic of Ecuador and the Ecuadorian Penal Code, as this information may be mishandled and cause people to be plagiarized. Executive Order mentioned Regulations for the Implementation of the Law on Internal Tax Regime, Article 65, Section Second, contrary to express provisions of the Constitution of the Republic of Ecuador and the Ecuadorian Penal Code
