| Resumen : | En el contexto del sistema jurídico ecuatoriano, la figura de la "Muerte Cruzada" y el control de constitucionalidad se presentan como temas de gran relevancia y debate. Esta investigación se enfoca en la potestad otorgada al Presidente de la República para disolver el Poder Legislativo mediante un Decreto Ejecutivo, conocido como "Muerte Cruzada", y explora hasta qué punto este poder afecta los principios de control de constitucionalidad y la salud del sistema democrático. La investigación aborda la interacción entre los poderes ejecutivo y legislativo en momentos de crisis, examinando cómo esta dinámica puede impactar el equilibrio de poderes y la democracia en el Ecuador. Se cuestiona la falta de control de constitucionalidad sobre dos de las tres causales que permiten la disolución de la Asamblea Nacional a través de la "Muerte Cruzada", lo que podría tener implicaciones en la rendición de cuentas y la transparencia gubernamental. El análisis se justifica en la necesidad de comprender a fondo los mecanismos constitucionales que regulan las relaciones de poder en situaciones de crisis política. Los objetivos de la investigación son analizar las causas que respaldan la "Muerte Cruzada" en Ecuador y examinar los autos emitidos por la Corte Constitucional en casos recientes sobre la presunta inconstitucionalidad para disolver al poder legislativo y para evaluar el control de constitucionalidad en el uso de esta figura. La investigación se desarrolla considerando múltiples perspectivas, como la legal, histórica y política, y explora la interpretación y aplicación de las normativas pertinentes. Mediante este análisis, se busca comprender cómo la relación entre los poderes estatales se manifiesta en momentos cruciales y cómo el control de constitucionalidad puede influir en la de los principios democráticos y del Estado de derecho en Ecuador. |
| Descripción : | In the context of the Ecuadorian legal system, the figure of the “Muerte Cruzada” (crossed death) and the control of constitutionality are presented as issues of great relevance and debate. This research focuses on the power granted to the President of the Republic to dissolve the Legislative Branch through an Executive Decree, known as "Muerte Cruzada", and explores to what extent this power affects the principles of constitutionality control and the health of the democratic system. The research approaches the interaction between the executive and legislative branches in moments of crisis, examining how this dynamic can impact the balance of power and democracy in Ecuador. The lack of constitutional control over two of the three grounds that allow the dissolution of the National Assembly through the "Muerte Cruzada" is questioned, which could have implications for accountability and government transparency. The analysis is justified by the need to fully understand the constitutional mechanisms that regulate power relations in situations of political crisis. The objectives of the investigation are to analyze the causes that support the "Muerte Cruzada" in Ecuador and to examine the orders issued by the Constitutional Court in recent cases on the alleged unconstitutionality to dissolve the legislative power and to evaluate the control of constitutionality in the use of this figure. The research is carried out considering multiple perspectives, such as legal, historical and political, and explores the interpretation and application of the relevant regulations. Through this analysis, we seek to understand how the relationship between state powers manifests itself at crucial moments and how constitutional control can influence the democratic principles and the rule of law in Ecuador. |
