| Resumen : | El Trabajo de Integración Curricular denominado: ANÁLISIS JURÍDICO, DOCTRINARIO Y COMPARADO SOBRE EL DELITO DE DISCRIMINACIÓN LABORAL EN EL CÓDIGO ORGÁNICO INTEGRAL PENAL, fue elaborado con el propósito de conocer cómo la discriminación laboral afecta a los derechos fundamentales de los trabajadores y que esta debe ser tipificada en el Código Orgánico Integral Penal, asimismo se desarrolló como requisito previo a optar el título de Abogada, de acuerdo con lo establecido en el Reglamento de Régimen Académico de la Universidad Nacional de Loja. El análisis jurídico, doctrinario y comparado sobre el delito de discriminación laboral en el Código Orgánico Integral Penal, es importarte dentro de nuestra sociedad, debido a que engloba a todo el entorno laboral y, se integra la vulneración de los derechos constitucionales y fundamentales de trabajadores, el presente trabajo de integración curricular tiene la intención de centrarse en la vulneración a cada uno de estos derechos garantizados por la constitución y las demás normativas presentes en el Ecuador, dentro de este estudio jurídico, comparado y doctrinario, se observan las causas por las que se suscita la discriminación laboral y a su vez, sus consecuencias, constantemente las personas obvian esta situación, los trabajadores evitan denunciar estas conductas por miedo a ser despedidos o a represalias, lo que se ha comprobado en los varios testimonios observados en las entrevistas, en el marco teórico se describen los diferentes tipos de discriminación que se llegan a dar dentro del entorno laboral como: la discriminación por embarazo, edad, discapacidad, género, raza, origen nacional, color, etc.; también se estudiarán a fondo las consecuencias que estas producen, como lo es la depresión que, gracias al estudio de casos y noticias, se observará la relevancia de este tema y que por ello, se debe tipificar dentro del Código Orgánico Integral Penal, así como la necesidad económica, derivada de la discriminación, afectando al ingreso laboral y el impacto de esta hacia los miembros del núcleo familiar, con la información recopilada, hallaremos que es eficaz tipificar estas acciones discriminatorias dentro del Código Orgánico Integral Penal conjuntamente con una pena privativa de libertad con base al análisis, jurisprudencia y doctrina, ya que son los bienes jurídicos los que se vulneran, la sociedad y autoridades deben tomar conciencia sobre este problema y sancionar de manera efectiva, dentro del marco legal, este delito, contribuyendo a disuadir su práctica y proteger los derechos de los trabajadores, siendo estos, objetivos fundamentales para una sociedad justa y equitativa. |
| Descripción : | The Curricular Integration Work called: LEGAL, DOCTRINARY AND COMPARATIVE ANALYSIS OF THE CRIME OF LABOR DISCRIMINATION IN THE INTEGRAL ORGANIC CRIMINAL CODE, was developed with the purpose of knowing how labor discrimination affects the fundamental rights of workers and that this should be typified in the Integral Organic Criminal Code, also was developed as a prerequisite to opt for the title of Attorney, in accordance with the provisions of the Academic Regulations of the National University of Loja. The legal, doctrinal and comparative analysis on the crime of labor discrimination in the Organic Integral Penal Code, is important in our society, because it encompasses the entire labor environment and integrates the violation of constitutional and fundamental rights of workers, this work of curricular integration intends to focus on the violation of each of these rights guaranteed by the constitution and other regulations present in Ecuador, Within this legal, comparative and doctrinal study, we observe the causes of labor discrimination and its consequences, people constantly ignore this situation, workers avoid reporting these behaviors for fear of being fired or retaliation, which has been proven in the various testimonies observed in the interviews, the theoretical framework describes the different types of discrimination that occur within the work environment as: pregnancy, age, disability, gender, race, national origin, color, etc. discrimination; we will also study in depth the consequences that these actions produce, such as depression, which, thanks to the study of cases and news, we will observe the relevance of this issue and therefore, it should be typified within the Integral Organic Penal Code, as well as the economic necessity, derived from discrimination, affecting the labor income and the impact of this towards the members of the family nucleus, with the information collected, We will find that it is effective to typify these discriminatory actions within the Integral Organic Penal Code together with a prison sentence based on the analysis, jurisprudence and doctrine, since it is the legal goods that are violated, society and authorities should become aware of this problem and punish effectively, within the legal framework, this crime, helping to deter its practice and protect the rights of workers, these being fundamental objectives for a just and equitable society. |
