Resumen : El presente trabajo de Investigación Curricular se titula “Falta de aplicación del principio constitucional de celeridad procesal para garantizar el principio de favorabilidad por parte de los jueces de garantías penitenciarias a favor de las personas privadas de la libertad”; y, su interés por desarrollar es debido a la realización de un estudio enfocado a la falta de aplicación del principio de celeridad procesal para asegurar el cumplimiento del principio de favorabilidad, ya que es evidente que en nuestro país no se hace una correcta interpretación y/o aplicación de las normas que están escritas generando inseguridad para las personas privadas de libertad en sus derechos que no son tomados en cuenta, siendo vulnerados en la aplicación de una correcta justicia. La Constitución reconoce a las personas privadas de libertad como uno de los miembros del grupo de atención prioritaria, aquellos contarán de igual manera con derechos y deberes; y, además contarán con justicia justa, equitativa e igualitaria sin importar su situación física, económica, religión o étnica. En el artículo 75 de la Constitución de la República señala que toda persona tendrá derecho acceder a una justicia gratuita y a la tutela efectiva, imparcial y expedita de sus derechos e intereses, con sujeción a los principios de inmediación y celeridad; en ningún caso quedará en abandono. El artículo 5 numeral 2 del Código Orgánico Integral Penal, la favorabilidad en el caso de conflicto entre normas jurídicas se aplicará la menos rigurosa de modo que se optimice su máxima efectividad para el titular de derechos. Además, durante el desarrollo de este trabajo se aplicaron tanto materiales como métodos que permitieron avanzar en la realización de la presente investigación, de igual manera se realizó las encuestas y entrevistas dirigidas a profesionales del derecho de la ciudad de Loja y profesionales del Cantón Balsas, aquellos criterios con fundamentos claros y precisos; con bibliografía reconocida a nivel mundial, los mismos que aportaron a la comprobación de objetivos y a la fundamentación de la reforma legal; sirviéndome como apoyo para platear el proyecto de reforma legal al Código Orgánico Integral Penal con la finalidad de garantizar que se dé el cumplimiento efectivo en los procesos que se solicita la aplicación del principio de favorabilidad por parte de las personas privadas de libertad y así evitar que se vulnere el derecho a tener una justicia justa y equitativa.
Descripción : The following research work entitled, “Lack of application of the constitutional principle of procedural celerity to guarantee the principle of favorability by the judges of penitentiary guarantees in favor of persons deprived of liberty”; aims the realization of a study focused on the lack of application of the principle of procedural celerity to ensure compliance with the principle of favorability, since it is evident that in our country there is not a correct interpretation and/or application of the rules that are stablished by the law, which generates insecurity to persons deprived of liberty, whose rights that are violated when it comes to the application of a correct justice. The Constitution recognizes persons deprived of liberty as one of the members of the group of priority attention, who have equal rights and duties; additionally, they will have fair, equitable and equal justice regardless of their physical, economic, religious or ethnic situation. Article 75 of the Constitution of the Ecuadorian republic states that all persons shall have the right to access free justice and to the effective, impartial and expeditious protection of their rights and interests, which must be subjected to the principles of immediacy and celerity; in no case shall they be abandoned. Moreover, Article 5, numeral two of the Organic Integral Penal Code, indicates favorability in the case of conflict between legal norms, the less rigorous one will be applied so as to optimize its maximum effectiveness for the rights holder.
