| Resumen : | La presente tesis constituye el informe final del proceso de investigación elaborado y sustentado jurídicamente en la legislación ecuatoriana el mismo que lleva por título “REFORMA AL … Art (25.1) DE LA LEY ORGÁNICA DE SERVICIO PÚBLICO, PARA QUE SE SANCIONE AL EMPLEADOR QUE NO GARANTICE EL DERECHO A LA DESCONEXIÓN DIGITAL, SALUD OCUPACIONAL Y ENTREGA DE EQUIPOS, ELEMENTOS E INSUMOS AL SERVIDOR PÚBLICO QUE TELETRABAJA”, cuya finalidad es analizar la importancia de la aplicación de sanciones administrativas en lo referente a la vulneración de derechos del servidor público, establecidos en la Ley Orgánica de Servicio Público en cuanto al teletrabajo, propiciamente hablamos del Derecho a la Desconexión digital, Salud ocupacional y Entrega de equipos, elementos e insumos, los mismos que son de gran relevancia en el ejercicio de esta modalidad; pues de cumplirse conforme a lo dispuesto en la ley, se transmitiría al sector público la seguridad de que el teletrabajo es una forma confiable, eficaz y apta para ser ejercida, evitando de esta manera la disconformidad y resistencia que varios profesionales han demostrado, justamente por el incumplimiento de sus derechos, es por ello que prefieren retomar sus trabajos en la forma tradicional, no debiendo ser así, porque estarían en contra del teletrabajo, lo que sería igual que oponerse a la tecnología, la que además de encontrarse en parmente evolución hace parte de todas las realidades humanas, volviéndose indispensable su requerimiento ya que no solo estaría vigente hasta la extinción de la pandemia sino que ha venido para quedarse, tomar poder en todos los aspectos sociales, académicos, laborales, |
