Resumen : La Constitución de la República del Ecuador en su Título Cuarto, Capitulo Cuarto, sección segunda en lo referente a la Justicia Indígena nos establece: Art. 171.- Las autoridades de las comunidade pueblos y nacionalidades indígenas ejercerán funciones jurisdiccionales, con base en sus tradiciones ancestrales y su derecho propio, dentro de su ámbito territorial, con garantía de participación y decisión de las mujeres. Las autoridades aplicarán normas y procedimientos propios para la solución de sus conflictos internos, y que no sean contrarios a la Constitución y a los derechos humanos reconocidos en instrumentos internacionales. El Estado garantizará que las decisiones de la jurisdicción indígena sean respetadas por las instituciones y autoridades públicas. Dichas decisiones estarán sujetas al control de constitucionalidad. La ley establecerá los mecanismos de coordinación y cooperación entre la jurisdicción indígena y la jurisdicción ordinaria. Nuestra Constitución de la República reconoce una serie de hechos y derechos que responden a la realidad con respecto a la cultura indígena, se reconoce finalmente que dentro del Estado coexisten diversas culturas con espacio con espacios jurídicos suficientes para que cada una mantenga sus peculiaridades e identidades. Un Estado pluricultural determina la coexistencia de varias culturas, que deben ser respetadas, la visión de la justicia ordinaria hacia el sistema indígena debe valorar los aspectos positivos que la justicia indígena tiene, y que ha mantenido a través del tiempo como un símbolo cultural sui generis. ¨Hay un significado mucho más antiguo y común en el cual piensa la mayoría de personas cuando se pronuncia la palabra cultura: como atributo del hombre ¨cultivado. Este último es reputado por dominar los saberes que le permiten ir más lejos en el conocimiento de todos los aspectos de lo real, así como los métodos y equipamientos mentales que le permiten multiplicar y profundizar esta ciencia. Por otra parte se le atribuye posibilidades del mismo orden en el campo de lo imaginario en donde llega a ser capaz, por ejemplo de comprender y gustar formas de arte accesibles a otros, así como de crear el mismo otras nuevas. Este tipo de cultura abarca un cuerpo de informaciones y de valores privilegiados por el grupo a los cuales el individuo accede gracias a un sistema de aprendizaje particular que le da además el poder de enriquecerlos. Dentro de la justicia indígena, el derecho consuetudinario ha encontrado mecanismos de sanción para los individuos que han violentado las normas de conducta que son respetadas por la comunidad indígena. El derecho indígena tiene dos elementos que cualquier sistema jurídico los tiene como son la jurisdicción y la competencia, que se ejerce en razón de las personas y en razón del territorio. Un sistema en el que las autoridades de las comunidades indígenas receptan la noticia, juzgan y tienen poder para hacer ejecutar sus resoluciones, por lo tanto el sistema de justicia indígena, valido y legitimo. El Art. 171 de la Constitución de la República reconoce a la justicia indígena como un mecanismo alternativo de solución de los conflictos en las comunidades indígenas, ya que determina que: Las autoridades de las comunidades, pueblos y nacionalidades indígenas ejercerán funciones jurisdiccionales, con base en sus tradiciones ancestrales y su derecho propio, dentro de su ámbito territorial, con garantía de participación y decisión de las mujeres. Las autoridades aplicarán normas y procedimientos propios para la solución de sus conflictos internos, y que no sean contrarios a la Constitución y a los derechos humanos reconocidos en instrumentos internacionales. El Estado garantizará que las decisiones de la jurisdicción indígena sean respetadas por las instituciones y autoridades públicas. Dichas decisiones estarán sujetas al control de constitucionalidad. La ley establecerá los mecanismos de coordinación y cooperación entre la jurisdicción indígena y la jurisdicción ordinaria. Todas estas interrogantes nos señalan que existe una grave problemática en un sector importante de la sociedad que repercute a nivel general en la población, Con los antecedentes señalados realizaré un estudio minuciosos de las normas reguladoras de la Justicia Indígena, para luego plantear un proyecto de reformas Legales encaminadas a logar que se cumpla lo establecido en la Constitución de la República, logrando la aplicación de una verdadera Justicia Indígena en el país, con el cual las personas involucradas en actos delictivos gocen de un debido proceso tal como lo reconoce el Art. 11 numeral 9 inciso cuarto.
Descripción : The Constitution of the Republic of the Ecuador in his fourth title, chapter room, second section with regard to the indigenous justice sets us: Article 171.-The authorities of the communities, peoples and indigenous nationalities may exercise jurisdictional functions, based on their ancestral traditions and his own right, within its territorial scope, with guarantee of participation and decision of the women. The authorities shall apply standards and procedures for the settlement of internal conflicts, and are not contrary to the Constitution and the human rights recognized in instruments international. The State shall guarantee that the decisions of indigenous jurisdiction are respected by the institutions and public authorities. Such decisions shall be subject to the control of constitutionality. The law shall establish mechanisms of coordination and cooperation between indigenous jurisdiction and the jurisdiction ordinary. Our Constitution recognizes a number of facts and rights respond to the reality with regard to the indigenous culture, is finally recognized that within the State coexist various cultures with space with sufficient legal spaces to keep each their peculiarities and identities. Indigenous law has two elements that any legal system has them such as jurisdiction and competence, which is exercised because of the people and the territory. A system in which the authorities of the indigenous communities receptan the news, judging, and have the power to enforce its resolutions, therefore the indigenous justice system, valid and legitimate. Article 171 of the Constitution of the Republic recognized indigenous justice as an alternative mechanism for the settlement of conflicts in the indigenous communities, as it determines that: "the authorities of the communities, peoples and indigenous nationalities may exercise jurisdictional functions, based on their ancestral traditions and his own right, within its territorial scope, with guarantee of participation and decision of the women." The authorities applied standards and procedures for the settlement of internal conflicts, and are not contrary to the Constitution and the human rights recognized in international instruments. All these questions point out us that there is a serious problem in an important sector of society that has an impact at a general level in the population,. With the above background, I will make a thorough study of the rules governing the indigenous justice, to then raise a project of legal reforms aimed at attaining compliance with provisions of the Constitution of the Republic, making the implementation of a genuine indigenous justice in the country, with which persons involved in criminal acts enjoy due process as recognizes it the Art. 11 paragraph 9 fourth subparagraph.
