| Resumen : | La presente investigación proyecta un análisis sobre la Ley Orgánica de Educación Superior y el marco jurídico sobre el que se suscriben algunos procesos académicos en este nivel educativo, como son "los cursos de nivelación de carrera". Si bien estos se han logrado mediante una corresponsabilidad entre instituciones, y derivada de Convenios y Contratos académicos entre las universidades y el SENESCYT, en casos particulares la ejecución de estos acuerdos ha generado inconvenientes en su ejecución y su administración. Por este motivo el objetivo de la investigación es analizar la incidencia de la norma vigente en lo referente a nivelación y admisión, mismos principios que se suscriben en su respectiva Ley (LOES). La metodología que se propone para este objeto es el estudio de la normativa vigente, además de considerar las disposiciones Constitucionales en cuanto al tema, y la discusión de estos argumentos en torno al marco jurídico que nos compete. Finalmente entre las conclusiones y recomendaciones de la investigación se presentará una propuesta reformatoria a la Ley con respecto al tema referido, teniendo en cuenta que en el actual modelo educativo estos cursos se constituyen en un requisito necesario previo al ingreso a una Universidad o Escuela Politécnica. |
| Descripción : | The investigation projects an analysis on the Organic Law of Higher Education and the legal framework on which are subscribed some academic processes in this educational level, as they are "the leveling courses of career". Although these have been achieved through co-responsibility between institutions, and derived from agreements and academic contracts between universities and SENESCYT, in particular cases the implementation of these agreements has generated inconveniences in its execution and administration. For this reason the objective of the research is to analyze the incidence of the current norm in terms of leveling and admission, the same principles that are subscribed in its respective Law (LOES). The methodology proposed for this purpose is the study of the current legislation, in addition to considering the Constitutional provisions on the subject, and the discussion of these arguments around the legal framework that falls to us. Finally, among the conclusions and recommendations of the research, a reformatory proposal will be presented to the Law with respect to the above subject, taking into account that in the current educational model these courses constitute a necessary precondition before entering a University or Polytechnic School. |
