Título : El seguro social campesino en la ley de seguridad social

Resumen : El presente trabajo de investigación pretende evidenciar la vulneración de los Derechos del cual son objeto los campesinos del Ecuador, que a pesar de contar con una Constitución en la que se reconoce al Estado como de derechos y Justicia, esta no está siendo aplicado en el sector rural ecuatoriano. En materia de derechos el campesinado ha ido conquistándolos paulatinamente, es así que el acceso a la tierra, al agua, a la educación, a la salud, entre otros ha permitido que un sector se vayan potenciándose económica, social y políticamente, sin embargo hoy se les restringe sus derechos a pesar de estar amparado en la Constitución, uno de ellos es el derecho a la Seguridad Social y dentro de este el derecho el acceso al Seguro Social Campesino. El Seguro Social Campesino, se inició en agosto de 1968 y es catalogado como un seguro único en Latinoamérica y quizá único en el mundo por sus características particulares: Uno de ellos es que el campesino no necesita mantener una relación de dependencia con patrono o con empleador alguno, más bien su carácter es familiar y comunitario; otra característica particular es con respecto a los sujetos de protección que destinado a diferentes pueblos y nacionalidades, lo que le hace ser intercultural; y, una tercera características es que es de bajo costo, eficiente de amplia cobertura y de gran empoderamiento de los beneficiarios. En 1998, en la Constitución elaborada y aprobada en ese entonces el Seguro Social Campesino adquirió rango constitucional, es decir dejó de ser garantizado solo por la ley, y es garantizado por la Constitución, que además de garantizar el derecho a la Seguridad Social los campesinos también se hizo extensivo al pescador artesanal, con esto involucra a los actores fundamentales de la alimentación de los ecuatorianos, haciendo justicia a quien realiza el esfuerzo tanto en el campo como en el mar. Con todo este nuevo marco normativo, el Seguro Social Campesino logra incrementar su cobertura. Con la Constitución del 2008, la Seguridad Social en el sector rural es un seguro especial del Seguro Universal obligatorio, que se extenderá a toda la población urbana y rural, con independencia de su relación laboral siendo que el Seguro Social Campesino protegerá a la población rural y al pescador artesanal. Esto no se está cumpliendo por lo que se vulnera el Derecho a la Seguridad Social de los hombres y mujeres del campo, que como ciudadanos y organizaciones tienen Derechos. En torno a la vulneración de los Derechos de los campesinos a la Seguridad Social, tenemos que indicar que actualmente el IESS, no está permitiendo la afiliación de nuevos afiliados del sector rural por cuanto se amparan en la ley de Seguridad social, específicamente en el artículo129, en el que se plantea que la incorporación de nuevos afiliados y beneficiarios deben guardar relación directa con el crecimiento del número de afiliados al seguro general obligatorio. Que a todas luces es inconstitucional y por lo tanto viola derechos garantizados por la Constitución. El acceso a un Derecho que tienen un ciudadano o colectivo, y que está garantizado por la Constitución, no puede ser obstaculizado, y menos negado por el acceso o no que tengan otras personas al Derecho de la Seguridad Social. Siendo más pragmáticos los hombres y mujeres del sector rural no pueden estar a la espera de que otras personas se afilien al Seguro General y en ese momento concretar su derecho a la Seguridad Social. Los derechos serán de directa e inmediata aplicación, manifiesta la Constitución, por lo tanto no puede tener un intermediario ni condicionalidad alguna. En este marco al ser el Derecho a la Seguridad Social de aplicación directa y con el fin de darle un marco legal es necesario reformar la Ley de Seguridad Social para garantizar el derecho a la Seguridad Social de la población del sector rural, de manera colectiva e individual.

Regarding the vulnerability of the peasants' rights to Social Security, it should be pointed out that currently the IESS, the affiliation of new members of the rural sector is not allowed because they are covered by the social security law, specifically article 129, Which states that the incorporation of new affiliates and beneficiaries should be directly related to the growth of the number of members to compulsory general insurance. That is clearly unconstitutional and therefore violates rights guaranteed by the Constitution.
