Resumen : El ejercicio de la Acción Penal Privada garantiza que las personas o Víctimas de la infracción puedan ejercer sus Derechos legales y procesales dentro de la Acción Privada, para el efecto se disponen Garantías específicas como la protección de la Víctima, a fin de que la misma no vuelva a sufrir las consecuencias del Delito, sea protegida en contra de cualquier amenaza que pueda vulnerar sus Derechos, por lo que es importante que dentro del ejercido de la Acción Penal Privada, se den mecanismos técnicos a fin de que se garantice que el Denunciante sea protegido en contra de cualquier tipo de intimidación sea física o psicológica. Por lo que me he propuesta la siguiente problemática: “REFORMA AL ART. 425 DEL CÓDIGO ORGÁNICO INTEGRAL PENAL, PARA IMPLEMENTAR LA PROTECCIÓN A LA VÍCTIMA O DENUNCIANTE EN EL EJERCICIO PRIVADO DE LA ACCIÓN PENAL”. Es necesario que se den reformas a fin de que se adopten medidas de protección que solo las da el Juez de Garantías Penales, como lo es la protección del testigos, vigilancia, e investigación de amenazas, puesto que las Victimas dejan abandonadas las causas, y por ende se vulneran los Derechos de las Víctimas, así como se causa una inseguridad Jurídica por la ineficacia de la Justicia. Es necesario que se dé una reforma al Art. 425 del Código Integral Penal, a fin de garantizar los Derechos Fundamentales de las Víctimas, por medio de mecanismos técnicos, o Medidas de Seguridad preventivas que aseguren el pleno ejercicio de los Derechos de la persona Denunciantes dentro del ejercicio de la Acción Penal Privada. En la actualidad, el Código Orgánico Integral Penal, contempla las acciones públicas, mediante el principio de oficialidad, es decir que aunque no exista la Denuncia o Acusación Particular, la misma se impulsa de oficio por parte del ministerio público, dejando el principio de mínima intervención, dentro del ejercicio de la acción tanto pública como privada, que solo el Ministerio Público intervienen, cuando no exista otros mecanismos para hacer valer los Derechos procesales de las partes. De ahí la necesidad de crear mecanismos de prevención como lo es la Denuncia, que en nuestro régimen Penal no es formalista, no son parte o sujeto procesal quien Denuncia, puede realizarla de las formas que prescribe la Ley verbal mente o por escrito, por terceras personas, mediante poder especial, o procuración judicial a un profesional del Derecho, de igual forma que puede hacerlo la Víctima., Familiares o personas conocedoras del Delito de la infracción, o las personas profesionales obligadas a Denunciar por mandato de Ley . La falta de Denuncia dentro del ejercicio de Acción Penal Privada, genera que se deje en desigualdad procesal ante la Ley, se violente o vulnere los Derechos de la Víctima, y por ende no se respete el Debido Proceso y Legalidad, generando que exista más impunidad y aumento de tasa de Delitos, el Control Social Punitivo conlleva a prevención mediante la Ley, garantiza la igualdad de Derechos de la partes procesales.

At present, the Comprehensive Criminal Organic Code, contemplates the public actions, through the principle of officiality, that is to say that although there is not the Particular Denunciation or Accusation, it is promoted ex officio by the public ministry, leaving the principle of minimum Intervention, in the exercise of both public and private action, which only the Public Ministry intervene, when there are no other mechanisms to enforce the procedural Rights of the parties. Hence the need to create prevention mechanisms such as the Denunciation, which in our Criminal regime is not formalist, are not a party or procedural subject who denounces, can perform it in the forms prescribed by the Law verbally or in writing, by third parties Persons, by special power, or judicial procuration to a professional of the Law, in the same way that the Victim can do it, relatives or persons knowledgeable of the crime of the infraction, or the professional persons obligated to Report by mandate of Law. The lack of Complaint within the exercise of Private Criminal Action, generates that it is left in procedural inequality before the Law, violates or violates the Rights of the Victim, and therefore does not respect the Due Process and Legality, generating that there is more Impunity and increase in crime rate, Punitive Social Control leads to prevention by means of the Law, guarantees the equality of Rights of the procedural parties.
