Resumen : La aprobación de la nueva Constitución de Ecuador representa un gran avance para la realización del derecho a una ciudad digna en la región. El texto, refrendado el 28 de septiembre de 2008 en reemplazo de la anterior Constitución de 1998, aborda de forma innovadora el derecho a una vivienda y a una ciudad digna. Desde el Preámbulo, los alcances del buen vivir – sumak kawsay en lengua quechua aparecen como objetivo primordial de la nación y condición fundamental para la convivencia ciudadana en la diversidad y la armonía con la naturaleza. Son varios los derechos humanos económicos, sociales y culturales, individuales y colectivos, que están reglamentados en el marco de «los derechos del buen vivir» (Artículos 12 a 34 del Capítulo II), tales como el derecho al agua, a un ambiente sano, al hábitat y a la vivienda, a la cultura y la ciencia, etc. El derecho a la vivienda está inserto en el contexto más amplio del pueblo, la ciudad y el medio ambiente en general, esto es, el de un hábitat seguro y saludable tal como lo garantiza el artículo 30 de la Constitución. Sin embargo existe una vulneración del derecho constitucional a la vivienda, en la disposición contenida del Art. 190 del Código Civil, que dice si existe un solo bien social destinado a vivienda, se conferirá derecho legal de uso y habitación a favor del cónyuge a quien se le confíe el cuidado de los hijos menores de edad, inclusive el titular del derecho de uso y habitación tiene facultad de ejercer acción posesoria (amparo de posesión) en contra del cónyuge que intente transgredir la prohibición de cohabitar, esta contradicción al derecho al 50% de gananciales de uno de los cónyuges afecta sin lugar a dudas al otro cónyuge tiene derecho al cincuenta por ciento de gananciales sobre el bien destinado a vivienda, y por ende es un absurdo la prohibición de cohabitar en un bien en la que tiene derecho de propiedad. La imposibilidad de cohabitar dura hasta que los hijos dejen de ser incapaces, lo cual afecta de sobremanera si es que el hijo es recién nacido, por lo que significa que durante 18 años no podrá cohabitar en una vivienda en que tiene el 50% de la propiedad.
Descripción : The adoption of the new Constitution of Ecuador represents a breakthrough for the realization of the right to a dignified city in the region. The text, endorsed the September 28, 2008 to replace the previous 1998 Constitution, innovatively addresses the right to housing and a dignified city. From the Preamble, the scope of the good life - sumak kawsay in Quechua appear as primary objective of the nation and essential for peaceful coexistence in diversity and harmony with nature condition. There are several economic, social and cultural, individual and collective human rights, which are regulated within the framework of "the rights of good living" (Articles 12-34 of Chapter II), such as the right to water, to a healthy environment , habitat and housing, culture and science, etc. The right to housing is embedded in the broader context of the village, the city and the environment in general, that is, that of a safe and healthy habitat as guaranteed by Article 30 of the Constitution. However there is a violation of the constitutional right to housing, the provision of Art. 190 of the Civil Code, which says if there is one social good for housing shall be conferred legal right of use and occupancy for the spouse who be entrusted with the care of minor children, including the holder of the use and occupancy has power to exercise possessory action (under possession) against the spouse who attempts to violate the prohibition to cohabit, this contradiction to the right to 50 % of acquisitions of one spouse undoubtedly affects the other spouse is entitled to fifty percent of acquisitions over good for housing, and therefore the ban is absurd to cohabit in a well in which it is entitled property. The impossibility of cohabitation lasts until the children stop being incapable, which affects greatly if the child is a newborn, which means that for 18 years can not live together in a house that has 50% of the property.
