Resumen : El principio de igualdad es uno de los derechos de los cuales gozamos todos los ecuatorianos, el mismo que consiste en la igualdad de trato para todas las personas y condena la discriminación, todos tenemos los mismos derechos y garantías ante la ley, nadie puede dar un trato desigualitario a una persona por su religión, filiación política, cultura entre otros. La presente investigación esta caminada a tratar la vulneración del derecho de igualdad, ya que en el Código de Trabajo y en la LeyOrgánica de Servicio Público se está haciendo una diferenciación entre el trabajador y el servidor público, ya si es verdad que el trabajador presta servicio físicos o manuales y el servidor público presta servicios intelectuales ambos son trabajadores y al establecer regímenes de vacaciones distintos se está dando un trato desigualitario y por lo mismo se está incumpliendo el derecho de igualdad. En nuestra Constitución de la República del Ecuador se establece que será inconstitucional cualquier norma que disminuya el goce y ejercicio de los derechos, esta norma está siendo incumplida ya que en el Código de Trabajo se establece quince días de vacaciones incluidos los días no laborables para el trabajador a partir del año de trabajo, pudiendo este tener un día más a partir de los cinco años consecutivos de trabajo bajo el mismo empleador, pero este beneficio no podrá pasar de quince días, además estos días extras de vacaciones lo deja a consideración del empleador ya que si este le quiere dar estos días adicionales le da si no este tiene la opción de pagarle esos días al trabajador. En cambio en La Ley Orgánica de Servicio Público se establece un régimen de vacaciones para el servidor público de treinta días de vacaciones a partir de los once meses de trabajo; con esta disposición legal se está disminuyendo el ejercicio del derecho a las vacaciones al trabajador aparte que se está dando cierta desigualdad de trato entre estos dos tipos de trabajadores. Con esta pequeña introducción es notorio que existe un grave problema en la legislación laboral ecuatoriana, puesto que existe incongruencias entre los días de vacaciones que tienen los trabajadores y servidores públicos, provocando esto la vulneración de sus derechos, además de que no se cumple con la finalidad de la vacaciones que es el descanso y recuperación de energías para el ejercicio de sus labores; de lo antes anotado concluyo estableciendo una propuesta de reforma al Art. 69 del Código del Trabajo garantizando en este el derecho de igualdad, a través de la implementación de un régimen de vacaciones igualitario entre el trabajador y el servidor público, para así dar fiel cumplimiento a los derechos establecidos y garantizados por la Constitución.
Descripción : The principle of equality is one of the rights that all Ecuadorians enjoy the same consisting of equal treatment for all people and condemns discrimination, we all have the same rights and guarantees under the law, no one can give a inegalitarian to a person because of religion, political affiliation, culture among other treatment. This research is walked to treat infringement of the right to equality, since in the labor code and the law on public service is making a distinction between the worker and the public servant, and if it is true that the worker serving physical or manual and intellectual public servant provides services both are workers and establishing different regimes vacation is being given unequal treatment and therefore is in breach of the right to equality. In our constitution of the Republic of Ecuador states that will be unconstitutional any rules that reduce the enjoyment and exercise of rights, this rule is being breached and that the labor code is set fortnight's holiday including non-working days for the year worker from working, this may have more one day after five consecutive years of work under the same employer, but this benefit may not exceed fifteen days, besides these extra days of holiday leave it for consideration by the employer as if it wants to give these extra days you give if it does not have the option of paying those days the worker. With this rock introduction is known that there is a serious problem in the Ecuadorian labor law, since there is inconsistency between the days of vacation for workers and public servants, causing this violation of their rights, and that is not complied with purpose of the holiday is rest and recovery of energy for the exercise of their duties; than before annotated I concluded establishing a proposed amendment to Art. 69 of the Labour Code guaranteeing the right to equality, through the implementation of a system of equal holidays between the worker and the public servant in order to comply faithfully the rights established and guaranteed by the constitution.
